Offence
On 10 February 2016, after heavy drinking, he argued with his wife, held a replica handgun to her head to scare her, then fired a home-made sawn-off .22 rifle at the front gate. The prosecutor alleged he also put the home-made gun to her head and pulled the trigger. Police found the rifle and about 70 rounds hidden in the house. He did not tell the Board about the charges, his suspension or his sacking. Pleaded guilty in Maryborough Magistrates Court (8 March 2016) to threatening violence (domestic violence offence), dangerous conduct with a weapon, unlawful possession of weapons and possessing prohibited explosives. Twelve months' probation; no convictions recorded.
Outcome
Registration cancelled and disqualified from reapplying for only one year (he had already been suspended since 2016). No costs order. QCAT (Judge Sheridan with assessors N Alexander, M Halliday and S Lewis). The Health Ombudsman first sought only a 1-2 year suspension, then cancellation with 1-2 years' disqualification; the tribunal chose the minimum one year.
