Luke Borusiewicz — A Child’s Life, Warnings And Preventable Loss
Luke Borusiewicz: His Life, His Family's Warnings And His Death In Foster Care
Luke was a little boy who sang, played music with his dad and loved being held. Michael Borusiewicz's accounts describe a close, affectionate father–son relationship and the pain of seeing Luke taken away repeatedly. Luke died on 18 January 2009, aged two years and four months. His father says his death was preventable and that the people responsible for protecting him failed to listen and act.
This casefile brings together the family's accounts, witness interviews, correspondence, archived inquest reporting and the father's responses. The personal testimony is attributed to its speakers. Quoted departmental responses and inquest material remain identifiable as those sources; they do not replace the family's account.
Warnings Before Luke's Fatal Injury
Michael describes concerns about Luke's placement with a 74-year-old foster carer who was also caring for three older children. He says he raised concerns about supervision and reported scratches, burns, bruises and other injuries. He describes repeated unsuccessful attempts to contact Child Safety management and the complaints service, and says both parents' concerns were ignored.
The Injury, Delay And Loss Of Luke
The family's account dates Luke's serious head injury to 12 January 2009. Michael says Luke was left without timely medical help and that repeated calls were required before an ambulance was arranged. He describes a fractured skull, bleeding on the brain, the week in hospital and being with his little boy when life support ended on 18 January. The source accounts retain their own descriptions of the timing and injuries.
After Luke's Death
The archived correspondence records Michael's questions to the coroner, his contact with the complaints service and the response he received. The inquest took place on 25–27 July 2012. Michael disputes the handling of evidence, the response to the reported delay in obtaining help and the conclusions reached. His letters and responses are included below, alongside the archived reporting, rather than being reduced to administrative labels.
The Family's Continuing Loss
Michael's accounts of birthdays, music, Luke's belongings, the effect on Luke's sister and his own grief explain what was lost. His central demand is for responsibility for Luke's safety, the warnings that preceded his death and the way his family was treated. The dated accounts below preserve that detail and emotion.
Letter To The Coroner Regarding the Death of Luke Borusiewicz
Archived Post 2012-02-10 · Lukes Dad
I made the Docs Qld Queensland department of community services child protection officer wait while I filmed this last video of me jamming with Luke, then they took him away to foster care.
January 29th, 2009.
TO: Cairns Coroner,
5B Sheridan Street.
CAIRNS. 4870
FROM: Michael Borusiewicz
I am the father of the Child Luke Borusiewicz. I have some concerns regarding circumstances surrounding the death of my son resulting from injuries which occurred on Monday 12th of January, 2009.
He was not under satisfactory supervision at the time of his death.
I disagreed with decision to place my child with a 74 year old woman who was already burdened with three older children, all at home on school holidays. This would make it virtually impossible to show the care and attention needed for a two year old child. I voiced my concerns to Child Safety officer Liz who supervised my visits with Luke, immediately upon her informing me of his change of residence and carer. I also stated I was worried about the 3 older children bullying my child, and a constant list of previous injuries which he had sustained.
The injuries sustained by my child.
I am puzzled by the severe bruising of his right pointer finger. The police are confident the old lady was not capable of causing such an injury but I would like you to take into consideration it may have been caused by one of the other children, who were the only witnesses to the actions which caused Luke’s death.
My suspicion is that he may have been held by the right pointer finger by someone’s left hand whilst being struck by the other hand. Not knowing the size of the other children I would ask that you consider and investigate these as legitimate possibilities.
The constant injuries sustained by Luke whilst in the brief care of this elderly lady.
These included a severe burn to his hand and constant severe bruising to his head and body. At the day I last had contact with Luke he had scratches on his face which I asked the visit supervisor Liz to record. Other injuries were also witnessed by visit supervisors, Peggy and Joanne at previous visits.
Two days after my last visit with Luke his mum saw a severe scratch on his penis which needed medical attention. I was also informed by Joy during this week prior to the injury that he had severe bruising on his bum. She stated that it was from jumping off his bed. She informed me that she could not control him and he kept jumping off the bed. Did she inform child safety that she was not capable of proper care and control of Luke.
Why haven’t Child Safety been forthcoming with the list of previous injuries?
The failure to act on my concerns as a father about my child’s safety with this carer.
During the week preceding his fatal injury and immediately upon being informed of his placement with this carer, I embarked upon a tireless but futile attempt to have him removed from Joys custody.
The contacts I made with child safety include:-
When I spoke to the visit supervisor Liz during the visit on 5.1.09
A phone call with Liz 6.1.09
A phone call with Josephine from child safety complaints in Brisbane on 9.1.09
A meeting with supervisor Liz and Team Leader Joe on 9.1.09
3 unreturned phone calls to Pat Anderson manager of Child Safety in Cairns. 2 of these were on 9.1.09 and one was on 12.1.09.
Luke’s mother, Jacky, also voiced her concerns about his safety whilst in the care of Joy.
Why he was not given proper care at the time of his injury.
Why was he allowed to ‘sleep’ from 11am til 5pm. I rang the carer, Joy, at 11am on the day of Luke’s injury. She informed me he had returned home, hit his head whilst having a tantrum and had been put to bed.
I was very concerned after this phone call and immediately attempted to contact Pat Anderson, the manager of Child safety in Cairns. This was my third attempt to contact her and voice my concern over his safety whilst in the care of Joy. None of my calls were ever returned.
I also rang Liz from Child Safety Cairns and repeated my concerns. This was the third time within a week of the fatal injuries occurring, that I informed Liz of my fears for Luke’s safety. First, at Luke’s visit the week before, and secondly, during a phone call when she informed me, two of the children were to be removed immediately so that Luke would receive proper care. The third time was during a phone call to organise a meeting with Liz and the Team Leader Jo.
I phoned Joy’s home phone at 1.30pm on the same day. The phone was answered by a child, who informed me Luke was asleep.
I rang a third time that day at 5pm to talk to Luke and was told he was still asleep. I commented that he doesn’t usually sleep that long and told her I would ring again soon. I did not want to upset his carer so decided to ring again the following morning.
My mobile phone activity report can verify the times, when I rang.
The inaccurate account of times supplied by his carer
I am suspicious of the reasons for supplying a misleading account of times for Luke’s injuries occurring and when he was put to bed. His carer knew his usual time for a daytime sleep was 1.30 and that it was highly unusual for Luke to go to sleep at 11am. As he returned from the visit an hour and a half earlier than normal, Joy would have been informed and well aware of his early arrival. I am suspicious that she is trying to hide the fact that his going to bed at this time, had never occurred before and was therefore a result of his head injury.
I am also concerned, as the father of a deceased child, and as the father whose child was placed in a supposed - ‘sanctioned safe environment’. Who is responsible for sanctioning a 74 year old woman as a full-time carer of four young children. Even a responsible person half that age would have their work cut out for them, so why was Luke placed with a carer, who even admitted she did not want the added burden of another child; said, she did not want him – and yet, Child Safety saw fit to overload a 74 year old woman with a very active 2 year old, thus creating an extremely DANGEROUS environment of uncontrollability and neglect.
I believe the Child Safety Officers involved in the decision making processes of this case should be investigated thoroughly for neglecting their duty of care, - in (a) allowing a 74 year old woman to ‘care’ for 3 children, let alone 4 – plus, what about the other three children still in her ‘care’? Are they ‘safe’?? Do they suffer constant injuries?? Is anyone monitoring this?? Do ‘carers’ attend a basic first aid course, which would point out the obvious steps to adhere to if a child sustains a head injury- don’t let them sleep for 6 hours. Was it only my child who suffered constant injuries and would this be an indication of bullying from the older children.
I simply ask that you consider my concerns when you conduct your investigation into the matter,
Regards
Michael Borusiewicz.
Lukey's Sister Kayla
Archived Post 2012-03-06 · Lukes Dad
I recharged my batteries today. Each time I go to my dad's workshop, I go through the shipping container he has out the back, full of Lukey's stuff, and his family's. By the end of it I am devastated, with so much anger, it spurrs me on to keep fighting for justice for my son Lukey, anf for everyone they are still treating in this way. Some of Luke's stuff has rotted, and there is a bit of rubbish. I always find something for some kid that comes to mind. I go through and tidy it up until the memories become too much, and I break down.
"Lukey Lukey Lukey", I cry.
Then I come out of there with a small handful of mementos, go to my dad's office and hug him with tears in my eyes, tell him how much I love him, and leave. He has 25 people working for him, none of them know what to say, they never look at me when I leave. What can they say, there is nothing anyone can say. They all saw how much I loved my son, and anyone could see the love in his eyes for me.
Lukey's sister Kayla was a beautiful child, such a peaceful nature like Luke, and Luke's oldest sister Jesse. They were not my daughters, but I loved them and tried to treat them as my own. I didn't think I could have kids, as much as I loved them, and they loved me. I had tried with several girlfriends, and didn't think it was possible, but I prayed for a son, since I was seventeen, and alway thought that it was in God's hands, and with God anything is possible.
So before Luke was conceived, Kayla came in one day and called me daddy. It was the most beautiful thing that had happened to me in my life, and I thought it was the closest I would ever come to being a dad. Kayla has an awesome dad who she loves more than anything, but to give me that gift I thought I would never had was sure something. She loved to draw, and never stopped, and I would help her as much as I could.
So I prayed for a son for a son for twenty years, and Luke is what God gave me. So today I found the drawing from Kayla, with a message on the back from Lukey's mum, I will cherish it for always. I love you Kayla and Jess, my little girls.
I also found the Thomas the Tank CD, it was from the Thomas the Tank show bag which I bought for Luke when I took him to the show, he was nine months old. I bought him seven show bags, even though he was only a baby, but it turned out to be a great idea. I put them all at his great grandmother's house, and as he grew older, there were new toys from each show bag for his updated age group. I remember I took Luke to Toyworld, and every toy he touched I threw in the trolley, filling a whole trolley, he was almost two I think. I am thankful I could not have been more generous with Luke, even in the dreams I still have of him, I always give him everything. I could not have told him I loved him more often than I did either. Luke knew love, and Luke showed me what love is.

Michael: How long have you know Lukes Dad?
James: I have known Lukes Dad for five years.
Michael: How well did you know Luke?
James: I have known Luke since he was born. He played with my daughter on numerous occasions. I nursed him many times. I know both of Lukes parents. I visited Lukes home on a frequent basis.
Michael:Have you ever had a drug problem?
James:No (laughing). I dont touch any drugs and never have, and never will.
Micha
el: How was Lukes Dad as a father?
James:Caring. Protective. For eexample, Lukes dad always set a good example for Luke. Like playing piano with him. Holding his back up while he sat at the piano so he wouldn't fall backwards. He was only seven months old but Lukes Dad had Luke on the piano everyday. Lukes Dad took Lukes music practise very seriously, but made sure it was always just good fun for Luke. He never forced Luke to do anything. Luke saw his daddy play music, so Luke wanted to play music. Luke saw his daddy do art, so Luke wanted to do art.
Michael: What was Lukes Dad like when it came to drugs being around Luke?
James: He didn't want drugs anywhere near Luke.
Michael: What did you think of Lukes mum as a parent?
James: As a mum she was probably ok but it was her havits that were letting her down. She was always getting drunk. If someone is that drunk all the time, how could they care properly for Luke?
Michael: How do you think Luke felt about his Dad?
James: He loved his dad, no question of that. He responded to his dad. He loved his dad. He was very clingy. He clung to his dad. He knew exactly who his dad was and felt comfortable with his dad.
Michael: Do you think Luke was better off with his Dad or his Mum?
James: I think Luke was better off with whoever was sober or not drug affected at the time. It wasn't a case of if he was better with mum or dad, it was a case of whoe was capable.
Michael: The last six months of Lukes life when he was in foster care, do you think Lukes Dad had taken care of his drug habit enough to have looked after Luke? You saw Lukes Dad at his worst on drugs. Did he come good at all?
James: Michael showed vast improvement after being counselled by atods detox and atods counsellors at the hospital and in the city. He also kept regular appointments with lifeline counsellors, relationships Australia, he did a toddler parenting course with lifeline. I drove him to many of these appointments. I knew I wasn't wasting my time with Lukes Dad. He wanted Luke back so bad he would do anything for his son. Prior to the appointments, Lukes Dad was clean, dressed well, sober, and doing everything possible, making every effort to regain custody of his son.
Michael: Do you think Luke was better off with his Dad than in foster care?
James: Any child is better off with their natural parents. I dont know anything about the foster carer or the situation but I do know the end result. Lukes Dad would never have let that happen. He would keep an eye on Luke every minute, and check him closely even when Luke was sleeping.
Michael: Do you have any children. How old are they and would you trust Lukes Dad to look after your child?
James: Yes, I have a daughter who is 9 years old. Michael has looked after her on occasions.
Michael: How did you feel towards Luke?
James: He was a bright little intelligent boy. Always smiling. Always happy. He loved playing with my daughter. Especially in the swimming pool Lukes Dad bought for Luke.
Michael: What happened the night before Luke died, when you lwent to the hospital to say goodbye to Luke?
James: I didn't get to see Luke and say goodbye. I found Lukes Dad and a few close friends of the family in the waiting room. I was first to enter with Lukes dad for a final visit but we were flatly refused entry by hospital staff. Lukes Mum had put a stop to all visits. There was a whole waiting room full of people who knew and loved Luke and not one of them got to say goodbye. Lukes Dad had sent messages to all close friends and relatives advising them that Lukes life support was to be turned off in the morning and now was the time to pay their final respects. Michael took it all in his stride and remained calm as possible.
Michael: Is there anything that Lukes Dad could have done to get Luke back that he didn't do?
James: I dont know the situation well enough to know if it could have been different. I just know what the result was, and that was horrific.
Michael: What events surrounding Luke and his Mum do you remember?
James:Lukes Mum was always anxious. She had anxiety and tried to compensate with alcohol. Her older two daughters were no longer in her care, but with their father. The times when I saw Luke, and his mum and dad together it was mostly harmonious until the influence of alcohol for Lukes mum affected her judgement and Lukes dad would become frustrated by her state as he knew she could not look after Luke in that state.
Michael: Tell me about the time Lukes Mum arrived on your friends doorstep without the baby. Where was Luke and what state was lukes Mum in?
James: She arrived very very drunk. It was evening. Both myself and my friend Mark looked at each other puzzled as she arrived without Luke. I think Lukes Dad was away on a painting job for a week or two. She was very drunk so I went to the house where they were living at the time and collected Luke and brought him back to Marks, where Lukes mother was. I was horrified. The first thing we asked when she arrived was where is Luke. It was only a month later That Lukes mum set the house on fire so Luke was only five months old. She started the fire by putting a teatowel on a lamp. This was despite Lukes Dad continuously warning her about the fire danger. She had the lamp thirty centimetres from Luke while he slept when it caught on fire.
Michael: What is your best memory of Luke?
James: Just nursing him. Holding his little hands, looking at his eyes, he dribbled on me a couple of times. Luke was a gifted child, you know. He just seemed to have music down pat. Like he would be tapping away or playing piano with his Dad. He purely enjoyed melody with his singing.. He was just a fun little kid, he was. He was his parents pride and joy. I was sad to hear he was hurt and even more sad not to have lost him.

Lukes Dad: What do you remember most about Luke?
Mathew: I remember the first time I met Luke and his Dad. The first time I went over to Michaels house I could hear music coming from the house and a baby singing before I even entered the yard.
As I entered Michael was playing piano and baby Luke was standing beside his father with a microphone in his hand. He was singing. I was expecting a choir from the sound I heard from outside, but it was just Luke and his Dad singing.
Lukes Dad: How well did you know Luke and what did you think of him?
Mathew: I came into contact with Luke on a number of occasions after becoming friends with his father. I always found Luke to be "Daddy's Little Boy." Everytime he saw his Dad his face would light up and his grin was from ear to ear.
Lukes Dad: What did you think of Lukes Dad?
Mathew: Michael came across as a very loving father. It sickens me to think that our system which is so simple can be so wrong. If they (DoCS) did their job properly and investigated the facts instead of favouring heresay from one person, not always the parent either, they would have seen that all families have problems and 99% of the time families work out their own problems.
Lukes Dad: What about drugs around Luke?
Mathew: As an ex-addict myself, and somebody who has completed a Queensland Government drug court programme that was specifically designed for people like us, I can say not once did I ever see Michael put his drug habit before the boy.
Lukes Dad: So you are saying that Luke was well looked after?
Mathew: I was surprised when I went to the fridge. I thought it would be like mine and have no food. But Michael's fridge was always filled with food for his son.
Interview with Karyn ****** by Michael Borusiewicz

Sat, 23/05/2009 - 20:10 — Lukes Dad
The following is an interview Karyn ******* conducted on 23.5.09 by Michael Borusiewicz.
Michael: How well did you know Luke Karyn?
Karyn: Reasonably well. I first saw him when he was a couple of weeks old. I went to your house in Hoare St. after the baby had been brought home from hospital. I had known Michael and Jacky for some time before this.
Michael: What did you think of Luke's Dad as a father?
Karyn: Perfectly competent. You were a father, you just get along with it. I heard that after the fire at Hoare St. there had been some trouble with Department of Child safety. When I visited Luke's home in Sturt St Luke's Dad told me that him and Luke's Mum had separated and she had left Luke with him.
Michael: How did Luke's Dad feel about this do you think? About Luke being in his care.
Karyn: He was delighted. He was very happy he had his son and he was happy. He was obviously devoted to Luke. He was undergoing treatment for his drug problem and the house was clean. Luke was happy and healthy.
Michael: How many kids have you raised Karyn? How old are they?
Karyn: I have 3 children. Lauren is 19, Jimmy is 16 and Eli is 8.
Michael: How did seeing Luke for only two hours a week effect Luke's Dad?
Karyn: Severely. It would effect anyone to have department of child safety decide they are an unfit father, and then only to see their only child for two hours a week. It changed his outlook on life. Luke was the focus of his dads life. Luke was his universe, reduced to two hours a week on a department of child safety supervised visit. It traumatised both parents and Luke. Especially frustrating as Luke's Dad was abiding by all of child safety's demands, and still he was getting nowhere.
Michael: When Luke's dad had Luke on his won, was Luke properly looked after? Did you ever see Luke abused or neglected by Luke's Dad?
Karyn: No.
Michael: Was the better parent in your opinion Luke's Mum or Luke's Dad?
Karyn: Luke's Dad, Luke's Mum had a 5 year history of neglect and abuse which was documented by the department of child safety. I have read the affidavit written out by the department of child safety.
Michael: What did Luke's Dad do that stood out as something more than most fathers would do for their children. Is there anything significant.
Karyn: His dedication to improving his life so as to improve Luke's. As well as teaching Luke music everyday. Luke's dad idolised Luke and Luke idolised his father.
Michael: What was Luke's Dads fridge like? Was Luke fed properly when he was in his fathers care?
Karyn: Huge and full of food. I am a diabetic so I spend a lot of time in peoples fridges. I have to eat properly. One morning I dropped over and had my insulin. I had to eat and when I came to Luke's house Luke and his dad were sitting out the back with a bowl of porridge for Luke. He made me one too.
Michael: Are there any other memories that stick in your mind when you think about Luke and His Dad?
Karyn: Going round to Sturt St and Luke's Mum was drunk, obnoxious. She was abusing Luke's Dad.
Michael: How did Luke's Dad react?
Karyn: He was keeping calm, he was very patient with her.
Michael: Was she abusing Lukes Dad in front of Luke?
Karyn: No. Luke was asleep.
Michael: Was Luke clothed and changed properly when he was looked after by his father?
Karyn: Of course he was. Whenever I saw Luke with Michael he was always well cared for, supervised and he looked healthy and happy.
Michael: What other memories do you have of Luke's Mum?
Karyn: Running into her at the solicitors. She was very jittery and seemed borderline hysterical. She had Luke with her.
Michael: Any other memories?
Karyn: I saw her at hospital when Luke was in intensive care from his head injuries. Michael had left the ward to allow Luke's Mum to have time with Luke. He was concerned about Luke being on his own. Luke's mum promised she would stay with him so we had lunch, me, Luke's Dad and another friend. On the way back to the car we saw Luke's mum leaving the hospital. She had assured Luke's Dad she would stay for a couple of hours at least and would not leave Luke alone. She had only been half an hour and she left, leaving Luke alone in the hospital, much to his Dads distress.
Michael: How was Michael when Luke was dying in hospital? What did you see happen?
Karyn: He was traumatised. He was basically at the hospital from the time he got the phone call until Luke died six days later. He didn't want Luke to be alone. He tried everything possible, he talked to Luke, he sang to Luke, he annoyed the doctors and Nurses with endless questions to ensure Luke got every chance possible to perhaps come good. He was hoping for a miracle. I would also like to ad that the level of service from the staff at CBH was exceptional. It was a tragic situation and they would always talk and explain what was happening.
Michael: Do you think Luke was better off with his mother or his father?
Karyn: His father. She was an alcoholic and a nastie pastie. I could go on at length, but I wont.
Michael:Do you think Luke was better off with his dad or in foster care? Why?
Karyn: His Dad. No one can ever love a child like their parents love them. Look what ended up happening to little Lukey in foster care.
Michael:Would you trust Michael with your child?
Karyn: Yes definitely. I had three children and Michael lived in our home with us. Michael took my youngest son to Cooktown with him, on a property with his friends. My son was well looked after and Luke's Dad acted responsibly. He is a good role model for my son.
Michael: Anything else you would like to add about Luke or his dad or Department of child safety?
Karyn: The whole incident is a tragedy. Someone has to be, not blamed, but held accountable. As for department of child safety, they took that child away from his dad and mum for his protection. They are not God.
Michael: I would like to point out that they are not always right. The problem is that in their eyes (department of child safety), they are always right. And who is going to tell them they are wrong when you risk losing your child forever?
One pissed off father that will not rest until this abuse of power and position by these untouchable man hating women is stopped. Stop killing our children you murdering pigs.

Now how is this for ironic.
Karyn received a letter from Department of Child Safety on the 20th of january, 2009. That is two days after Luke died. The letter reads-:
It has been assessed your children are currently in a safe environment where their care and protective needs are being met and that they have a parent who is willing and able to protect them from further harm. As such, your children are not in need of protection.
I had been living with karyn for 6 months prior to this letter and had informed child safety of this and asked to have luke in Karyns care with me. Before this I had moved in with a child care worker when I first came back to Cairns. She wrote a reference for me and informed them that she was happy to act as foster carer or guardian to Luke. With or without me on the premises. It was the second time this child care worker had approached child safety to offer to look after Luke.
The Day You Went Away (Last Memories of Luke and his Daddy)
Archived Post 2012-03-10 · Lukes Dad
Sat, 23/05/2009 - 12:19 — Lukes Dad
The day that DoCS (The Department of Child safety) took my little boy away.
I gave Luke that silver childrens size drum kit the day they took him away. That is what reminded me that the woman from the Department of Child Safety was watching when we filmed this. I wanted to show her how good he was. At this stage I had him singing, playing piano, guitar and harmonica every day and he had begun to draw.
His mum had gone missing for a week and Luke and I enjoyed each others company more than anything in the world. On the last morning when he woke up, he started talking like I had never seen him talk before, neither would I see him talking so happily again. He was taken from me five minutes after this video.
The child safety woman did not give a reason for anything. She took him from his sleep, I was religous about his midday nap. The only people who ever woke him up, ever, during his midday nap was child safety. Twice.
He was taken and put with his mother in housing supplied by some emergency housing place. They took him despite his mothers long list of complaints from the public about the neglect of Lukes two older siblings, both born 7 years apart from each other.
In fact one womans shelter had reported her to DoCS and stated that all of her money was spent on Drugs and Alcohol and they were forced to feed the children. She was so drunk she asked them to ring an ambulance because she couldnt feel her legs.
Another womans shelter kicked her out on the first night because she got so drunk. Now on this day when they took Luke away I was fine, as you see in the video I did with Luke where I played piano and Luke sang and also played piano.
Once they rang me and asked me if I had been giving him lollies or soft drinks. I told them I always brought fruit and childrens drinks for the visits and enquired as to why they would ask this.
She told me that he was very upset and disturbed after our visit together. Any fool could tell you that is because he missed the one person who always protected him, adored him, worshipped him, spoilt him rotten.
Later they would take him from me, after I had been drug free and in a successful relationship with Lukes Mum as she had stopped abusing alcohol when we went to Townsville. He was taken away screaming by a policeman and shifted from foster home to foster home in Townsville, and then from foster home to foster home in Cairns, until he was left for six hours with a fractured skull while at one of those foster homes, this ultimately caused Lukes death.
My two year old son was kicked out of his foster home the day before christmas. Now if I did that to my two year old, I would be in Jail. If I left my little boy there with a fractured skull, bleeding on the brain, a blood clot, scratches on the face and a finger that must have been slammed into a door to be that purple, I would be in Jail.
Let me tell you how our government takes care of problems like these. Last year sixty three children died while in foster care.
This is what you call a cover up. Accidental 15, natural causes 20, unknown 12. How did 47 children that were known to child safety die last year. And not one of them are suspicious?
Now this is what I was informed by police. There was nothing suspicious to report. That is when I wrote my Letter to the Coroner Concerning the Death of Luke Borusiewicz in DoCS Qld Foster Care .

Hi Mr Borusiewicz,

I guess when you deal with the Queensland Department of Community Services, from what I have been told, you divide what they tell you up into blocks, this is the first block of lies.
It sounds as though these predators expect a thankyou after the way they treated my son. Never will they admit to having a fault, yet children are dying, that should have been saved.
Don't ever expect an apology. Expect these vial creatures to attack the parent from beginning to end, and lay all blame for their negligence at the parent's feet, no matter how devastated they are, no matter how much they love their children.
These people are cruel and vindictive, coated in arrogance.

Foster Carers Undermined by DoCS Banshees
This is a definitely a gray area where common sense and love should prevail. Because of the nature of this industry ann open mind and kind heart is needed from those with the best intentions of a child in mind. Countless horror stories reveal the cruelty in which helpless children have been subjected horrific treatment by their own parents who should never be around their own children. This situation should not be conveyed across all levels of parentling with every parent involved with all child protection authorities. The current system labels all parents as unfit the moment they come under the radar. They are victimized, humiliated, and denegrated as a failure as a parent without any substantiation of evidence. Whereas, the best way to help a child is to help the child in the majority of circumstances. How does it help a child for a foster carer to tell any child that their parents are inadequate, to show them love is the best any person can do for any child. When a foster parent grows strong emotional ties with the child in their care, they are in an unenviable predicament where they must always keep in mind the child may be returned to the parents at some time in the future.
The sad reality is that in most situations the foster carer reaslistically has better judgement than the child protection authorities. However, foster carers hold no creedence and are given no credibility with regards to the care of the child. Foster carers who are down to earth have little faith in the decision making abilities of teenagers who have completed a Tafe or University short course and given the ultimate power to decide the future of families and children, to split up marriages, place children in foster care, force parents to do courses, drug testing, counseling, etc. At this early stage a parent is traumatized and frantic with worry, yet receive no compassion. On many occasions, this is the same with grandparents. Should the child protection worker take a personal dislike to you, your parent abilities do not come into consideration. Personal vendettas are played out daily with parents left with no where to turn. Corruption is rife, the media is forbidden to reveal the truth, parents helpless to protect their children from the Monster which is Child Protection. Children and families are left at the mercy of evil banshees like Julie Freckelton and Mandy Ramsey who can be found at Bowral DoCS, NSW.

Hold the case worker of DoCS responsible for Child's Death
There has been some talk about what WNEP TV aired showing me. Let me explain something. My people already know, but for the edification of those who haven't heard I would like to expound. I advocate that the CPS follow the same constitutional guidelines as all the rest of us. No deeper than that! If a child is recklessly placed in a foster home and subsequently is injured, or dies, I say that we hold the case worker responsible for their actions. Simple. You don't take people's children and put them in harm's way and then act as if you had nothing to do with it. If you are driving the get away car during a bank robbery you are equally as guilty. If you are going to take our children away from us then by God you better keep them safe. That's the least you can do! I understand that some parents need to have children removed. We all do. There are cases where it is for the safety of the child. And if my solutions are a bit unsettling oh well! And this fine-hand dandy on that newscast saying he was "concerned" about the safety of the CYS workers after my statements? These people go into homes and take people's flesh and blood away. You weren't concerned until now? I think GEICO made a commercial where you crawled out from under a rock. As far as the events in Pennsylvania, I will not discuss that. I obey the constitution. A criminal case is in the hands of the D. A. and the officers of the court. My personal beliefs have no bearing on it, and I believe in the jury system in that it will uncover the truth. But I will say; Anyone, ANYONE who harms a child should stand before the law! And yes, I'm a revolutionary. I'm trying to implement a document some old cats back in the 1700's wrote. It worked real good until just lately, but I think it's got some life still in it. We the People! And I obey the law. The CPS here in Texas got a court order saying that I can never see my grandchildren ever again. They got it without proof of any wrongdoing on my part, and without me being able to defend myself in court, but you know what? I obey that order! I lost my wife of 28 years obeying that order. All I'm asking the powers that be to do is see to it that the CPS follows the law with the same respect that I do. I will never hold their precious faces in my hands again, and I sleep alone because five years ago me and my 27 year old stepson, Bobby, threw a beer can at each other at a bar b Q. Shouldn't have done it, wish I hadn't, but I did, and that's that and I have paid for my sin. . . with my blood! Never mind we ended up laughing at the party. Never mind that Bobby and I went to California shortly after that and spent the best two weeks of his short life. Never mind the fact that he had a terminal brain condition and called me his "best buddy." CPS had "reason to believe." They had "concerns." Now I fight for you. In the CPS's eyes I'm the Outlaw Josey Wales. Sometimes God girds our loins and sends us where we don't want to go. Sometimes the weight gets to me, but at other times I'll get a call or email and a young lady's voice will say, "Thank you. My child is home." When that call comes I always look over to the edge of the porch, and I can just barely see Bobby sitting there, and he says, "Whooped 'em again, Dad." And I always say, "Yeah, boy, whooped 'em again." God bless each and every one of you.

Michael you deserve a medal for what you are doing to DoCS
The DoCS staff responsible are trying hard to get out of this one Michael, but the fact still remains. He never died in your care. Half the world uses a drug of some kind, so send 'em off to rehab and meetings then, but the courts don't do enough of that... correctly either. They send them to a doctor who pumps them up with more. Keep going Michael. Not many have them cornered as well as you do. You deserve a medal or a real good holiday. maybe both. hugs hun.

Luke Deserves a Medal for Giving
The child protection system cost Luke his life and me, my son. They removed all responsibility from me when they dismissed my parental rights and passed judgement that they were more capable of raising my son than I. If he were left with me, he would still be here. There is no way I would have left him with a caved in skull for six hours, or done any of the cruel acts the department of community services did to poor Lukey. Luke Borusiewicz deserves a medal for what he went through. I am just a dad doing what a dad should do, and should have done long ago!

I know what you did to Lukey
Sent this to complaints .......
I am disgusted.
I am outraged.
I am let down.
Children should be protected.
12 months have past since I reported the severe neglect, of 2 little girls....
Little girls living in filth and animal excretement, on par with what was uncovered in South Australia in the house of horrors. I made many phone calls to the regions child safety department.....I sent photos of the worst lice infestation I have ever seen. I told them what it was like inside the home. I told them how un cared for these little ones are.....they are thin, they smell, their clothing smells like acid cat urine. They turn up at my door and ask for food daily.....
What was done by CPS? NOTHING........NOTHING AT ALL.
Knowing what I know now about how children in 'care' (( pfft more aptly uncare)) are in real danger......
I would not of wasted my time calling you.
Children are being overlooked, Children are being let down.
What are you being paid for? To sit on your hands and allow this to continue?
OBVIOUSLY!
Children die in care in this country.
YOU FAIL CHILDREN DAILY!
Shame on you child safety Qld!

Child Safety waited til Luke and Dad finished this last song, then Took Luke away. Luke never played the piano and sang with Dad again. The drum kit in the film clip was brand new and was given to Luke that morning. Luke played it once then went to bed. Child safety came and woke him from his midday nap, and gave no reason for removing Luke. All she said to me was "You are doing the right thing."
I didn't have a clue what she was talking about because as far as I knew I had always done the right thing by my son, and handing him over to child safety to put him with his mother was not doing Luke any favours.

The next time the department of child safety took my son away
Luke was abused by his mother, before he was out of her stomach and up until the third time he was removed by child safety.
I don't talk of it much out of respect for Luke. He loved his mother. He was too young to know what was happening.
She would hurt him to get at me, she knew how much I loved him.
...
I tried to be there and protect him, but child safety refused to
consider me as an option because there had been domestic violence.
I don't condone my actions, but I tried everything. I hated her for what
she did to him, but stayed with her because child safety would not let
me take him.
The last day we had Luke, it was a Saturday morning.
I asked Luke's mother to turn off the television as video hits was on. I
had watched tv documentaries which stated that the sexual nature of
these music video clips were harmful to young children who were exposed
to these videos.
Directly after this she tried to give me oral sex, continuously, in
front of Luke. I had to leave the room as she would not stop.
Later that day, she got extremely drunk. She dragged Luke across the bitumen road, he was screaming.
I stood at the front gate and took hold of Luke, and refused to let her in.
She barged in, I could not do anything, I did not want to go down for being rough, so I let her in again.
My hands were tied, child safety considered me an unfit father, despite
my tireless efforts to do everything possible to have Luke live a normal
life, not being moved from foster home to foster home, being abused by
strangers(I know there are good foster carers, but the system is
overloaded by these DoCS workers who are eager to take your child, and
make it impossible to get them back.)
The neighbour rang the police, and apparantly there was an order out for
Luke because his mother did not tell them she was leaving Cairns with
him. I did not know this.
The judge in Townsville ordered that Luke remain with both his parents
in Townsville. This was ignored by DoCS, and they moved him from house
to house to house, until his skull was fractured and he was left to die
at the age of Two.
At this stage, I was living with the manager of St Vincent De Paul in
Cooktown, this way I was staying away from the drug circle in Cairns,
which is why I moved to Townsville.
When they told me they were moving Luke back to Cairns, I said to them,
"Are you trying to get me back on drugs?"
They laughed at me.
When I told the DoCS worker in Cairns of my plans to live in Cooktown
and travel to Cairns each week to visit Luke, she shook her head and
told me I would never do it.
I travelled four hours to Cairns every week, I would see Luke on a Monday for two hours, then I would travel four hours back.
Never once was I late, or did I miss a visit.
A week before Luke's skull was fractured, I had a meeting with Joh, the "Reunification" team leader.
I was handed a list of rules and
http://lukesarmy.com/images/lukes-dad/rules-contact-visits-handed-me-aft...
and warned if I broke them, I would never see Luke again. I had a list
of issues to discuss. I never got a chance. I was flatly refused any
extension of time to spend with Luke. This is supposed to be part of the
plan to help a child be reunited with his parents.
At the top of my list of urgent issues, was the fact that he was in a
highly dangerous situation living with a seventy four year old woman,
and three older foster children.
I did not even get a chance to discuss any of this.
Mon, 09/08/2010 - 23:30 — Lukes Dad
The day they came and took Luke away.
I only ever had Luke for one week on my own. When he woke up on the last day, he just started saying all these words. He had never talked like that before, and he never would again, even a year later.
They came and took him off me, and put h...im alone in a house they had organised for his mother.
I was worried sick. I rang child safety complaints, I rang every private investigator in the book, I even rang the minister for child safety's office. There was nothing I could do.
I was not allowed to visit the house, even though Luke's mother wanted me to.
We were told that if we were to continue our relationship, Luke would be removed and neither of us could have him. I was never given the option, even though Luke's mum had a long history with the department of child safety, with regard to Luke's two older sisters from her previous relationship.
I had never had any complaints lodged against me.
That was the day when I made the DoCS worker wait while I did this last video clip of Luke and I playing and singing on the piano. He was only one year old.

Luke was only ever woken twice whilst having his midday nap
I was religious about Luke's midday nap. People said I had first child syndrome, because I wrapped Luke in cotton wool. I saw what his mother did to him and felt so sorry for him. Child safety laughed at me when I told them he had been burnt by a cigarette. Don't believe me? Can you pick which pic has the photo of Luke's cigarette burn on the this site?

Lukes best times, that I witnessed and was a part of, was being with his Dad. Of course Lukey loved his mother, but my favourite time with Luke was when we hugged. I would just hold his little body against mine, and we would rest our heads on each others shoulders, and just stay like that for minutes, until the little boy would transform into a bundle of energy and I would have to let him go, feet running as he hit the floor.
Never would he wander too far from my sight though, for sadly Luke had been removed from my care, physically, so many times before.
That hurt the both of us more than anything I can imagine, let alone poor Lukey.
He was too young to know he had been given speed. That poor little baby suffered constantly, used as a knife, to cut my heart to pieces.
How easy, make me lose my temper with any means possible, and look like the poor hard done by wife.
Once this situation was evaluated, on face value only, my fete with Luke was sealed. I was always the bad guy and never given a chance, no matter how hard I tried, or how much my son loved me, or how much I loved my little Lukey Pookey.

We had so much love for each other
Me and my boy were inseparable. I fussed over him and considered myself to be his servant. The most upset I ever saw him was when the police took him, I was sober and six months drug free. I was never given a chance, I hit Luke's mum when she abused him, never in front of him but. Apparently it is worse to hit a woman than it is to burn cigarettes on your own babies face.

seriously
So first off reality check,
Now i SEE the real reason for your young child being taken from your care. Im glad i looked into it as i was starting to feel sorry for you,
If i knew of a child that was living in a home where he was being physically abused by his mother, lived with family violence (yes they can still hear even if not in the room) father is abusing drugs and alcohol and beats his sons mummy..
I would take him in a second because he deserves better than that in fact the united convention of children rights agrees.
In future before you slag off those (docs) who try to do their best. In this shitty society full of people who think they can raise kids as dogs. you had better be the most upstanding moral parent on the block. Which clearly you are not, you should think before you speak. ooopps not a skill of yours.
no im not a docs worker but as one soon to be i would suggest you invest in some valuable parenting and role modeling skills. Instead of blaming those who care on a website that offers no better SOLUTIONS.......

Honestly, Anonymous DoCS Wannabe give yourself a pat on the back
First off,
Anonymous insinuations from a self proclaimed family expert not even qualified yet advocating as some expert on child safety, hold no creedence in any place. Your lack of social ethic and cruel persona on the memorial site of a baby who died due to the negligence, malpractice and heinous ignorace toward children and parental rights is a disappointment to most, but a pre-requisite for employment by a department whose arrogance and failure to admit any personal or professional fault or responsibiltiy pertaining to their actions.
At least state your name and claim some responsibility before you even begin to pass your expert judgement or have you already instated the privelidge of having no responsibility for your actions, as you will enjoy should you terrifyingly become another hateful, spiteful and disrespectful DoCS staff member.
I am not interested if I am the most hated man in the world. I will speak the truth, and come forward and speak out about the way my son was treated, not by myself, but by DoCS. Numerous DoCS and Non Government staff who pleaded for the return of my son to me, were treated with disrespect, and dismissed by senior DoCS "Experts.
At one visit with my son, the visit supervisor returned to the DoCS office directly after the visit, and demanded my son be returned. When my son died, they were going to quit their job because they are sick and tired of watching this department ruin the lives of many.
I had a meeting three days before my son's skull was smashed in and he was left to die for six hours. I contacted them before the meeting with a list of concerns I wanted to discuss. At the top of that list was,
"Get him out of that house. He is always injured."
I didn't even get a chance to mention this. I was told that I was raising my voice and the meeting was over. The same woman said exactly the same thing in the waiting room at intensive care when I stated I had told her to get him out of that house. I told her there that when I get angry, I raise my voice, when she gets angry she takes people's kids off them.
And that is what it was in every office, a personal agenda. I was a father, and the mother always presumed innocent. I was told by lifeline it was my fault my son was burnt on the face with a cigarette, and fed drugs. DoCS laughed in my face when I told them, and found a house for my son and his mother, where I was not permitted to visit. I was never given a chance with my son.
At the meeting I asked the Reunification team leader for longer visits, the first step in the reunification process. I pointed out that other parents received longer visits after a few days or a couple of weeks. She told me that was other kids, not Luke.
I had travelled for six months four hours from Cairns to Cooktown for a weekly two hour visit, and then the return journey. Never once was I late or did I miss a visit. After every visit I would drop to the ground as he drove off and cry. It didn't matter what I did or how much I loved my son, or how much he loved me, my son's life was under the black cloud of the department of community services, Queensland, back then it was the department of child safety Queensland.
I had a friend who ran a child play centre who asked to foster Luke, she was refused. I was drug free for six months, with a reference from a Senior Seargent, this made no difference. There was nothing I could do, not even with my relentless attempts to point out the obvious to the senior staff at the department of community services, the complaints hotline, the manager of the Cairns North department of community services, the team reunification leader, the visit supervisor, like every person dealing with these untouchables, I had nowhere to turn.
Unlike the veiled underbelly of the department of community services, ruling politicians from the prime minister to the premiers to the Ministers for child safety, I will not be turning a blind eye, or more accurately aggressively and dishonestly be trying to hide the scale of this atrocity.
The last time I spoke to my son as he lay in his coffin, I rang the department of community services hotline, I rang the Townsville department of community services, and I rang another office I hold responsible for his death, the Cairns North Department of community services. I also believe the minister is ultimately responsible for his failing and corrupt department.
My son died with scratches on his face which I reported to the visit supervisor three days before he suffered a fractured skull while having his nappy changed by one of the three older foster children who also inhabited this highly dangerous residence.
These three children all had severe behavioral problems. They were in charge of changing my two year old son's nappies because the seventy four year old foster carer, refused to change nappies. She refused to take children under the age of four. She had already had children removed because of abuse and neglect.
A week after a DoCS officer stated a sick child poisoned from a spider bite needed medical attention, she had still not taken him to the doctor. Children were removed because they were being fed off the floor, without plates. She had physically abused them.
She was also addicted to poker machines and fueled her habit with her over abundance of foster children. This was all known by the seniour staff at DoCS., and my desperate pleas were tragically ignored.
Two days before my son's fatal injuries, his mother found severe wounds on his penis, which only due to her discovery were given the medical attention he was cruelly denied.
When these terrorists invaded my home and abducted my son under the false pretense of offering improved surroundings, they lied, and my son padi for it with his life. I never stopped trying and did more than asked to make these henious angels of death realise the love existing between my son and I.
I have seen all to often now that love and parental rights don't get a mention. Twenty five DoCS workers acting corruptly, including a private psychiatrist willing to give false reports in court to help the corrupt department of community services operate unhindered, desecrating the families in their path.
I promised Luke I would do something about what was done to him, and about the way these people treat people, and if it makes me the most hated man in the world, so be it.
I may not be perfect, but my son knows how much his daddy loved him, and I know more than any of these disgusting predators who falsely pose as the saviour of children, how much my son loved me.
You are cruel, arrogant, and narcistically place yourself above others already. I can only pray that you don't ever make it to a position of authority where a disadvantaged and disfortunate family is at your mercy. There are already enough of your kind in these departments, all too willing to judge and pass execution, with no consequences for their decisions relaying back to them.
They are in a win-lose environment. The department always wins, the family invariably suffer and lose from the presence of this abomination, the department of community services, world wide.

Hi Michael I just read about what happened to Luke and am so sadened they all new that he was being abused they aided the abuse which can only make you draw the conclusion that they were in on it. All the other children that are under the care of that dispicable evil woman are being abused as well thats why they have so amny problems. I know you will not want to hear what I think but I have to tell you anyway. I think she is allwoing paedophiles to sexually abuse the foster children that she has she is probably getting paid for this service, and if Luke was signed over for government mind control programming like most of these children are as young as Luke as well they are all protected by the national security act laws do not apply. The people working in govenment departments like DOCS that had Luke's file would have known exactly what was happening if he had been signed for mind control programming its trauma based its a possiblity. I read that his mother found that his penis was excoriated like there had been sexual abuse. I also know that jon bone Ramsey died during a satanic ritual the last baulb on the tree, and her skull was smashed during this ceremony and that is what killed her. That womans house needs to be watched 24/7 covertly to see who is comming and going she should not have children at all why are they allowing any of the children to remain ACTIONS SPEAK LOUDER THAN WORDS they are in on it. There are a lot of very evil people working in DOCS that are involved in satanic cults they are encouraged by the cult. This govenment sponsered mind control is a cover for a paedophile ring operation. NO ONE HAS THE RIGHT TO TAKE A CHILD AWAY FROM THEIR PARENTS its a god given right to be able to protect your own child, these people are making rules up that dont exists and getting away with it it unbelievable its satanic they are cold blooded lizards not like warm blooded humans at all they almost seem alien and if I found out this was the truth it would make sense.

"No one is blinder than he who will not see" -- John 9:40-41 "And some of the Pharisees who were with Jesus heard these words, and said to him, Are we blind also? Jesus said to them, If you were blind, you would have no sin: but now that you claim to see, your sin remains."
The last time I played with my beautiful litttle boy, Luke Borusiewicz

Mon, 27/04/2009 - 12:31 — Lukes Dad
The last time I played with my son Luke, he had only just turned two, and was a healthy little baby, apart from the scratches on his face. I was only allowed 2 hours a week with him for the last six months of his short life which ended on the 18th of January, 2009. Luke died at the age of two years and four months.
Two days after this photo was taken his mother had her 2 hour visit. Only after her discovery of more severe fresh scratches, this time on his penis, and after Luke's mum insisted, was he taken to a doctor for medical attention. These injuries and others, including severe burns, multiple scratches and bruising were a constant in Luke's life, while he lived with his Queensland Department of Child Safety sanctioned foster carer.
Luke was left with a fractured skull, bleeding on the brain, and a blood clot, unconscious for six hours. Only after I rang the foster home a third time that day to check on his well being, was he properly looked at and an ambulance was rung. By the time he got to hospital his brain had been so starved of oxygen that half of my little Lukey Pukey's brain was dead.
The first time I rang the house I was informed Luke had suffered a head injury and gone to sleep. I asked her to be very careful with his head as he had received a knock on the head before. She was awful to me, a 74 year old who already had 3 foster children in her care, two boys aged 4 and 6, and a girl aged 9.
Luke had been brought back to the same household where he had been inflicted with constant injuries before, after he was kicked out of his previous foster home, the day before Christmas.
I was not informed of Luke being placed with this woman until my visit with him on the 5th o January, and immediately questioned how this elderly woman would be able to look after him properly.
I informed the child safety officer he was always injured whilst in her care and that I was worried he would be bullied by the older children. I begged, he was fine with me, a previous visit supervisor had also begged them to let me have my son back. They told her I was paranoid but she strongly disagreed, but they had decided I was not good enough to be a father long before this.
Everyone could see how much I loved my son, and he would not leave my side. He was terrified of being removed from me, as they had done before.
I had moved to Townsville, which was the last step for me in my battle against drugs. I acquired secure work and earned over a thousand dollars a week. Half of this money went to the best solicitor I could find. Child safety Cairns refused to sign over the paperwork, Luke was taken away from his mother and I in Townsville, as child safety refused to let Luke stay while I was partnered with his mother. We argued too much.
God works in mysterious ways, and my new employer was a drug and alcohol counsellor of twenty five years, and three of his success stories were my work mates. Two of those were his sons.
I put my mind into my work, and every morning when my phone alarm would go off at 5 am, Luke's photo would come up and I would smile and say, "For you Luke, anything."
Luke was my reason for getting up every morning, my light at the end ot the tunnel was to get Luke back. I stayed drug free for six months until I followed Luke back to Cairns. Child safety Townsville put Lukey in two different foster homes then in a third house in Cairns. His mother was told she would have Luke if she left me in Townsville We were never given a chance to mend out relationship, offered any help or counselling or referred to anyone for help. They had decided from the onset I was to go, and the child would go with his mother. I prayed for my son for twenty years. He is the miracle God gave to me.
I moved back to Cairns, so I could keep up my two hour visits, which was all I now lived for. I went to child safety Townsville every day to show them I was working and drug free, and to beg for my son back. I got the same look I received from child safety Cairns supervisors, the elite who answer to no one, a look of hatred. I continued with ATODS appointments, I received counselling and advice from Centacare, took voluntary urine tests and kept a full time job.
I couldn’t work in Cairns, as I was doing too many courses and counselling, Lifeline, Centacare, Relationships Australia, ATODS, Solicitors, it was a full time job trying to get my son back.

The last time I played with you Luke
I am so glad I told you exactly how much I loved you Luke. I had to keep it together so you wouldn't get upset. It's only now I realise you were keeping it together so I wouldn't get upset. I used to drop to the ground and cry in front of the playground after every visit. I love you more than ever Lukey, I miss you so much every day.

My heart is breaking reading
My heart is breaking reading your story. My little boys name is also Luke.
I hurt so much for you and for your beautiful little boy. The injustice that has been thrown upon you is horrendous. I am all for "protecting" the children, but really, these workers need to realise they are not GOD. To me it reads like you did everything right to make sure your son would be in a safe stable environment when he came home to you, but some high and mighty power trippers thought they knew better.
I send you my heartfelt sympathy in your loss, and whilst I am not for revenge, I do hope that those people from DOCS and that old woman who should have been protecting your baby carry the guilt and shame for the rest of their lives. I do belive they should be held accountable for your babies uneccessary death.
Your Lukey is a gorgeous boy, it looks like he was having so much fun with you on your last visit. Carry tat memory.
My love and wishes to yourself and your family.

Who in their right mind puts four kids with a 74 year old woman.
If his father wanted Luke so bad why couldn't they put them together for a trial or something. Two hours a week for six months is not putting a family back together.

This is how child safety gave my baby back

This is how child safety gave my baby back to me. He was given back after they all visited him in hospital. This is a shocking photo I know, but I believe people need to be shocked to take in the truth of what is going on inside the department of child safety, not only in cairns, townsville, brisbane, queensland, australia, but the world.
These people, the management of Cairns north department of child safety, the child safety complaints hotline, the reunification team leader, all new exactly how dangerous that house was, and how numerous children had already been removed bacause of abuse and neglect from the foster carer. They all witnessed the continuous injuries Luke suffered while staying there, until he finally suffered a fractured skull, which killed him.
What was their response? A letter to me saying "Hi".

Hi Micheal, I feel so very
Hi Micheal,
I feel so very sad and frustrated for you, your family and Luke. My husband and I are just about to start legal proceedings againest Caresouth Nowra our local foster care agency. We we foster carers of three beautiful children for two years and the manager was such a bitch who didn't care about the kids at all. We made a formal complaint againest her as we felt she didn't have the kids interests at heart and she took the kids off us. The reasoning for this was that they said that we cared too much about the children. They didn't even let us say goodbye just took them from school. They then seperated the kids into different homes from each other. Two of the children suffer from numerous disablities and we are worried every day that they are'nt getting the proper care they need. I am still reciving letters from their doctors saying that they aren't attending their appointments. My heart goes out to you. I grieve the loss of the kids everyday.
with kind regards,
Renae

What a heartbreaking photo.
What a heartbreaking photo. Shame on the Australian government to have cheated this poor baby of his future. Somebody must be held responsible for this crime. The foster family and the ones who put this child into their care. I will be contacting the government to ask for an explanation and I encourage everybody to do the same thing.

Hi michael, I am so upset
Hi michael, I am so upset with your sons death. I have noticed that us in so-called "advanced nations" have the worst child safety. our death rates are terrible. I am in america, and have studied that australians, english and americans all are in terrible countries where our states are rewarded for taking children. Like a begger that grabs any kid and asks the federal govt for money and pushes the kid to wherever once they get their big bucks. In my county, pierce county, 11 children died in cps foster care in 2008. I told that to my worker and he said, "well a lot die in parents homes too" , my problem with that number "eleven" is that there is 160 kids not in foster care for every one kid that is in foster care. for eleven dead foster kids to be equally compared with non-foster placed children, there should be 1,780 deaths not in foster care. Like i said, each of the 11 foster kids represents 160 kids that arent in foster care. when you look at the stats, do the math. They hide behind poor math and naive people.
My name is alexis hayward and us as people need to change things and do research.
CPS is the most expensive way in history to tear away childrens future

Statistics for children who die in foster care
It is well documented that a child is much of the time in more danger from being in foster care than in the home they were taken from. Here is one study I came across recently.
Thankyou for commenting Alexis, it is good to have you in Luke's Army.

Still no coroner's report
I wrote that first letter to the coroner I think about a week after Luke died. They have to investigate it. I have since submitted another two letters to the coroner after uncovering evidence of how dangerous that home was, and how bad the foster carer was, and DoCS knew it, but they left him there ignoring all my desperate calls.
I can't do anything until the coroners report comes out, and then it is a game of CPS do their best to finish off a devastated parent with lies and manipulation. I don't care, I will jump in the fire for Lukey. I want him to get the justice he deserves. No child deserves to be treated like that, and no one does that to my little boy, especially after calling me a bad father. Everyone knew how inseperable Luke and I were.

I don't have words, they would mean nothing. Thank you for sharing your story. People need to know this can happen and the excuse can be weak, I have been told DoCs could choose to take my kids because of my parenting choices (educated and informed that go against the social norm eg. homebirth). Inquest into Death of Luke in DoCS QLD CPS Foster Care

Coroner orders Inquest into Death of Luke Borusiewicz while in DoCS QLD CPS Foster Care
This is as positive an outcome I can hope for from this tragedy. Luke's death cannot be hidden by department of community services Queensland (DoCS QLD), of department of Child Safety Queensland (also DoCS QLD) as it was known at the time of Luke's Death in foster care.
The terrifying reality is that now it is not the department of community services Queensland (DoCS QLD) on trial after having my child under the pretense of acting in the child's best interest, and falsely portraying themselves as an organisation which would better protect my child than I could, but myself who will be under the microscope.
Standard procedure for department of community services Queensland (DoCS QLD), department of community services NSW (DoCS NSW), in fact every Child Protection System (CPS) Department in Australia is to lay all blame on the parents whenever mistakes are made.
This harrowing experience is also dished out to grieving parents by Child Protection System (CPS) in the United States, the department of Human Services (DHS) in Canada, the department of social services (DSS) in the united kingdom and the numerous other falsely labelled child protection departments world wide.
I did not ask these people to remove my child. When they imposed themselves on his life they removed all parental rights and responsiblity from me, so what do I have to do with his death except for the fact I "tried to prevent it"!
What will change by making me out to be the worst father in the world when I had no control over what was done to my son, and "the department knew" how horrifying his situation was.
This is not a one off. Children are dieing daily due to the "negligence and corruption existing unchallenged
"which has infiltrated every child protection department in Australia, and most world wide.
When will these departments take a look at themselves? An inquest into Luke's Death is not enough, a royal commission into child safety in Australia is long overdue.
There is no independant watchdog for these poweful departments, only a disrespectful and unhelpful "DoCS Helpline"for each DoCS CPS department. Nothing more than an early warning system, to let them know of their stuff ups, and give them time to destroy the evidence.

For my brother Michael and the other men who will read this,
Michael,
When I first came across Lukes site I spent a good deal of that afternoon with tears in my eyes. Those who know me, and who know my former son Joshua, can speak to the fact that Joshua and Luke were of very similar features at that age. Seeing the pictures of Luke really pinged me and reminded me of Joshua at that age.
My former son merely dis-honoured himself and betrayed me. As far as I am aware he is alive and well. Luke was not so lucky. I have not experienced what you have experienced, nor would I wish to.
I can have no idea what you have gone through these last few years. I would not insult you by pretending I did.
When I read your story I made it my business to find you and introduce myself and ask you what, if anything, I can do to help you.
All you were asking for was some help with Lukes site. I was honoured and privileged you accepted my support and assistance in migrating the site to a new hosting site and making sure it stayed up and running. It was such a small thing to ask from a man who has suffered so much and who has fought so hard for justice for his son and many others.
As I have come to know you I have come to see you are, without doubt, one of the greatest living Australian Patriots today.
I am so honoured to call you my friend. One day we will sit together at a bar and I shall buy you that beer that you so thoroughly deserve.
Mark and I will not rest until such time as we either put the killer of Luke on trial or we have exhausted all possible avenues of investigation.
Stealing a mans house is one thing. Murdering a defenseless child is very much another.
Men like you are, sadly, very rare now. I wish I knew a few more like you. To say I am disgusted at the other men I have talked to who have turned a deaf ear to me is the understatement of the century. I know many millionaires. Men I have worked with who know me well. They are completely ignoring me. This despite the fact they know my character and know I am not a “bullshit artist”.
These men will, one day, be very publicly humiliated. They are not worthy of the title “man”. They turned a deaf ear when the children of their country needed them. I can think of no more disgraceful thing to do than that. I really can’t. Allowing children to be murdered by willful ignorance is beyond the pale.
So many men in Australia have so much to answer for by not heeding my call for their help. They really do. I will be ruthless and merciless in denouncing them for their refusal to assist us stop the murder of small children and the re-introduction of the rule of law into Australia. I shall not spare any man who turned his back on me. They can hate me for doing so ALL THEY PLEASE.
My own view is that having “courts with teeth” so that people know that they WILL be given a very severe remedy instruction for harming a child if they are tracked down and caught is the single most important thing we can do. I am committed to having “courts with teeth”. I call on ALL fathers in Australia to join us in implementing “courts with teeth” so that we can protect the next Luke.
You and I both know the cops, the lawyers, the judges, the magistrates, the CPS workers, the politicians and all associated people are just one big bunch of criminals who are trying to destroy families and demoralize the next generation. Sadly some little boys like Luke have been murdered in this process.
To assist you get back on your feet and to help you gain justice for Luke I am now sending you the $A5,000 that I promised you.
I challenge ALL other Australian men of means to meet this amount or better it. Let the word go out that I put $A5,000 in for Lukes charity and let those who have more than me (which is not much at the moment) meet my amount or beat it to assist you get back on your feet as well as pursue justice for Luke.
I am putting together a list of the MDs of the top 100 companies in Australia. Perhaps you can challenge them to meet my amount or better it. They are ALL far wealthier than I am.
In my own journey of being HATED ON and endlessly abused for doing nothing more than working to save the lives of children and men I have come to see who my friends are and who my friends are not.
My life has been greatly enriched by knowing you Michael.
You may be a humble man of humble means but I say this.
I have walked the halls of the rich and famous. I have worked with some who claim their greatness loudly.
I have not ever worked with or associated with a man with your guts and determination to do what you see is right.
My life is the better for knowing you.
You put many other men I know to shame. Every so called “man” in my extended family for a start.
May God bless you and yours Michael.
May we find the killer of Luke and bring justice for Luke.
May we be successful in stopping more Lukes from happening.
Keep up the good work.
Show those other Australian men what a real MAN looks like.
They need the education.
Best Regards
Your brother Peter

I taught my son in the bath everyday from six months old. Splish splash Splish splash Splish splash Splish splash singing while I tapped the water with my hands, therefore it was singing and percussion. I did this as I was startled when he sang to Bob Marley, they weren't words but he was definitely in time and in tune.
I started him on piano everyday at seven months old...

I also taught him tamborine...

I started drawing lessons just before he was taken off me by the department of child safety. The day they came and took him away I had bought him a childrens drum kit that morning...
http://www.youtube.com/watch?v=Xo7wInwk3P0
He played it once after they dragged him out of his bed during his lunchtime nap. I think it was the first time he was ever woken from his midday nap as I was religous about Luke's siesta, the house was in silence during the day while he slept, this was easy as his mum was usually sober at this time.

Luke had a jumping castle in his lounge room, it was Luke's house, and I was his servant. I always stuck to that rule.
This was Luke's lounge room...

They took him away and for the last six months of Luke's life I would see him for two hours a week. I was never late, I never missed a visit. I stayed with the head of St Vincent De Paul in Cooktown to rehabilitate from drugs. This made no difference to the department of child safety. The friday before my son received a blow to the head so severe it fractured his skull, caused a blood clot, bleeding on the brain and starved his brain of oxygen, on this friday, January the ninth, my birthday, I finally had the meeting I had been waiting three months for. I was called a child abuser. Told that I had abused my son and should admit it. When I tried to object I was told I was raising my voice, handed a list of rules for future visits and told that the meeting was over. I would continue travelling four hours from cooktown to Cairns and four hours back, every week, to see my son for just two hours.

This "reunification team leader" who was supposed to help me get my son back, still works for the department of child safety. So does the woman who employed her, Pat Anderson.
Please ring the department of child safety North Cairns and request an audience with Pat Anderson. I did, twice in the week before that meeting, once three days later while my son lay there dieing.
I also rang the foster home, three times while my son lay there dieing.
Jo, the "reunification team leader" who was supposed to help me get my son back, knew that my son was in a house where the foster carer was 74 years old. Jo also knew that there were three older children who had a history of being abused in that house, all home from school holidays.
I also know that Pat Anderson, the woman who is supposed to care about children and set an example for her employees, Pat Anderson knows that this 74 year old foster carer has a gambling problem and brings the foster children to the club while she gambles.
Pat Anderson also knows that this 74 year old woman has a history of abusing the foster children.
Pat Anderson alson knows that this 74 year old foster carer turns a blind eye while the older kids bully the younger ones.
The 74 year old also knew that my son had received a severe knock to the head, and left him to die.
It wasn't til six hours later, after my third phone call to the 74 year old foster carer, that she finally checked on my precious little angel, and rang an ambulance.
Pat Anderson, head of the department of child safety in North Cairns, Jo the "reunification team leader", how dare you call me a bad parent when you put my son in this position.
I rang the complaints hotline of the department of child safety in Brisbane and they were horrified when I informed them of the situation, they gave me the name of the manager of the department of child safety in Cairns, Pat Anderson.
Both of you, Pat Anderson, manager of the department of child safety in North Cairns, and Jo, team leader ot the "reunification team",

I'm so sorry
Oh my god! My little boy was born just a few days before your beautiful Luke but the following year. He is now only 3 months older than when he was taken from you. My son, and his younger sister, were wrongfully taken 6 months ago and it took 5 months of fighting before having them placed with their grandparents while we sort this crap out.
I am the strongest person I know, but I have absolutely NO IDEA how you manage to keep going. Every time I see a photo of your little boy I start bawling with tears streaming down my face, as I am now. I love my daughter as well but it's my little boy who reminds me of your Luke, they look a little similar. I imagine how your son would've been at the same stage in his development as mine is now. I think of all the funny little things he does, the way he speaks, the way he pronounces some words funny. I think about how he screams when he knows I have to leave him again (I can only see him once a week) and I know that you are thinking all the same thoughts. We trudge through an empty house now, the doors to the kid's bedroom and toy room closed. We have photos up but I look down when I walk past them because it makes me cry when I see my boy's innocent face beaming back at me in one of his photos. The only consolation for me is that I know I will see him again, and eventually get him (and his sister) back.
When I think of how I would feel in your situation I want to exchange my life for Luke's so you can live happily together again. I can't imagine the pain you must feel. I feel so angry that your beautiful boy was torn from you and made to pay with his life despite him having never done anything wrong. He was the innocent party, as are all the children in DOCS. They are the prisoners made to pay for crimes they never committed.
I seriously believe that if I were in your position I would be in jail or dead or both. I cannot comprehend any other outcome. I have the utmost respect for you and what you are doing and can't fathom the massive strength you must have.
I know the next time I see my son I will burst into tears because I will remember Luke.
I wish you all the best with your cause and I honestly hope that the loss of your son was not in vain. I hope that your strength inspires, and saves others.
Please accept my honest heartfelt condolences. I wish I could ease your pain. Love to you, your family, and most of all to your beautiful son Luke. I'm so very sorry.

Thankyou for your kindness and support
I am starting to look at other kids now and think, Luke would have been almost four now. My faith in God is the only thing that has got me through.
Even if I don't make it to heaven, I am 100% sure Luke will be there. I prayed for a son for 20 years and Luke was the miracle God gave me. When he was born I dropped to my knees in the hospital and said "He's yours God, take him when your ready."
I meant I wanted him to be a preacher but God had other plans. If I have someone to thank for changing my life and giving me a chance of going to heaven, it is my little Lukey Pookey.
Thankyou once again and good luck with your fight against the harpees. Thankyou for sharing your story on Luke's site too. The more people that come forward, the more this department will be exposed for what it is, a sham.
Letter to the editor Cairns Post Regarding Inquest of Luke Borusiewicz
Archived Post 2012-07-22 · Lukes Dad
I have agreed to do an exclusive with a news service, but am allowed to make a statement after each day of the inquest. Here is the statement I will make after the first day, which I sent to the Cairns Post....
Hi Damon (Editor Cairns Post),
I have agreed to give *** the exclusive on the story about Luke. However, I will say a short speech in front of the court at the end of each day of the inquest, and here is a rough draught or what I wish to say on the first day. If it wasn't highly defamatory, it wouldn't be me :)
I was a drug addict when Luke was first taken (FYI I am drug free six months at the moment, like I was while Luke was away, this made no difference). This is how I know of at least one drug worker working for DoCS Cairns North is a drug dealer. The system is full of drug addicts and pedeophiles working under the protection of the govt and media laws. Ecstasy is the drug of choice down at docs Cairns North. I demand that DoCS workers responsible for children be drug tested, starting with Colleen, a witness in Luke's inquest.
These vermin wait beside hospital beds for babies to be born, stealing them if a mother has smoked marijuana to help her through child birth. They work for the govt so they don't have to submit to drug testing.
There is only one way for this govt corruption to be stopped, the people of Australia, the community, it's victims, must stand up to them, and expose them, and bring them to justice.
The head of the drug counselling and rehabilitation service in Cairns, Atods (FYI Morag), is married to a senior Cairns Nth DoCS worker. I went for a drug test there which I know was clean on the day I had my last meeting with DoCS (I have witnesses) trying to get Lukey out of that house where he sustained his fatal injuries. Morag has since told me there is no evidence of this.
I have a reference from a senior sergeant of police in Cairns
http://www.lukesarmy.com/media-gallery/detail/676/506
after I worked for two months painting his houses, nothing I did made a difference.
An NGO visit supervisor demanded my son be returned after supervising a visit.
A particularly nasty senior Cns Nth DoCS worker's daughter, the receptionist at DoCS Cns Nth at the time, refused to put me through to manager Pat Anderson when I called repeatedly. All three knew what was happening and could have saved Luke's life.
The stolen generation, the migrant children, the forced adoption of single mothers, the Forgotten Australians.... and now the "New Stolen Generation by DoCS." Sorries are accomplishing nothing. Not this time. Sorry is not gonna cut it.
I don't know if you can consider this a letter to the editor or use any of it, but that is what I intend to say after court the first day anyway.
Kind regards,
Michael.
Child safety worker had 'no choice' when placing toddler Luke Borusiewicz in care
Archived Post 2012-07-25 · Lukes Dad
AN inquest into the death of a two-year-old foster child has heard his Cairns-based Child Safety Services caseworker was given ''no choice'' when it came to the home he was placed in.
Luke Borusiewicz died in January, 2009 after suffering a head injury while he was in the care of an elderly woman.
An inquest into his death opened in Cairns today, and his caseworker Elizabeth Bartley was asked whether she made the final decision regarding his placement.
''In theory, yes - but in practice I wasn't given a choice about who Luke was to stay with,'' she said.
''I was a very junior, new person.''
Ms Bartley said her supervisor made the decision, and that there was no other option but for Luke to stay with the woman in her 70s, who was looking after 3 to 4 other foster children.
She said she had "absolutely no idea" where Luke would have been placed if the carer was unavailable.
He had been with the carer for about three weeks when he slipped into a coma and died as a result of a head injury.
The inquest is set down for three days and will examine the circumstances around Luke's placement and the capabilities of his foster carer.

Department of child safety answers to no one
Archived Post 2012-08-07 · Lukes Dad
Tue, 07/07/2009 - 12:14 — Lukes Dad
While my 2 year old son was left lying with a fractured skull, bleeding on the brain, a blood clot, and his brain being starved of oxygen, I rang the head of child safety in Cairns.
They had removed him from my care and shifted him from foster home to foster home until he was returned to the 74 year old who already had 3 older children in her care. I begged them to give him back.
This was the third time in a week that I had rung Pat Anderson, the head of child safety in Cairns. Never once did she return my call. If I had contacted the mayor, or the head of police in Cairns you would surely be hearing about this.
This department is the most disgusting, callous, arrogant group of social workers this country has to endure, and they deal with our most vulnerable part of society, our children.
How do they get away with such lies, deception, malpractice and then waltz onto the next poor family which they do their best to rip apart?
Now before you write me off as another bad parent who should have looked after their child better, let me tell you that one of my supervised visits, which were only two hours a week for the last 7 months of my little baby's life, was supervised by a worker for an outside agency.
When she returned to the department of child safety after supervising my visit she begged child safety to return my child to me, and stated I was an excellent father.
They disagreed, and the decision of this "unification team" is answerable to no one. In fact when the judge in Townsville ordered that my baby stay in Townsville, the Department ignored the judge and moved Baby Luke to Cairns, where I had left my drug problem behind and moved on with my life, aquiring full time work and stable accommodation. Luke's mother was also in Townsville so why would they want to move him to Cairns. Cairns department of child safety did not want to hand Luke over to Townsville, so Cairns would say talk to Townsville and Townsville would say talk to Cairns.
This is not some car part or pet dog we are talking about, but my son that I loved more than I love life itself.
At the last visit I had with my son he had scratches on his face. While in this same foster house he had severe burns, and always had scratches or bruises. Two days later at his mother's visit he had a scratch on his penis so bad it needed medical attention. His mother begged them to get him out ot the house. Both times they told us he did it himself.
Two days after this I had a meeting which I had waited four months for. At the top of my list was to get him out of that house. I never even got a chance to bring it up. I was told I had abused my son and I should admit it. I was to stay on two hour visits and I was handed rules for visits.
I demanded an apology for accusing me of abuse and asked for proof. I was told I was raising my voice and the meeting was over. When I get angry I raise my voice, when these people get angry, they take your child. And who is there to stop them? No one. Three days later my son received the injuries to his head that would end his life. He died six days later in my arms, after I watched his brain die off and each organ shut down one by one, only his heart was beating and they turned the machines off.
Ask Caroline Overington from the Australian. She put my boys photo on the front page and spread the article across both the first and second page of the Australian. A victory for her trying to expose the injustice occurring daily in this department which is shrouded by media laws.
I lost everything I live for and I am screaming as loud as I can. Stop killing our children and wrecking families you despicable parasites of the unfortunate.

I have found your site after DOCS (NSW) removed my son in a crisis. They were right to take him, i was very drunk and was incapable of looking after him at that time. I was under the impression that i would get him back the next day (he is 11months old). I was told i would not get him back after numerous reports to DOCS, all of which were about the fact that i was scared for my unborn child when i had been drinking so heavly before i knew i was

They make the rules up as they go
They can't give you a definite time frame to be off drugs, they can hold it over you as an excuse to keep your child if they choose too. I can only assume it is the same with alcohol. No set rules, just take the kid and seeya later.
If you would like to start a forum about your son and put some pics up you are welcome. People need to see that these are real children and families that have been taken over completely. All they need is a tag saying department of child safety and that makes them an expert.
I know what hurt my son the most and that was being taken off me, Everyone could see how much I loved my son and how protective I was of him. The only people that ever dared call me a bad father was the ignorant breed which satiates DoCS.
There is more and more attention being paid to Luke's Army by politicians, the media, child safety and the public. Especially now that more people are exposing the injustices and inadequacies plagueing this department.
Inquest probes toddler foster care death of Luke Borusiewicz
Archived Post 2012-08-09 · Lukes Dad
A father whose young son died in foster care says he hopes an inquest into the toddler's death will expose flaws in Queensland's child safety system.
The Coroner's Court in Cairns, in far north Queensland, is this week examining the death of Luke Borusiewicz, 2, who died after sustaining head injuries while in the care of a 74-year-old woman in 2009.
Yesterday, the court heard the toddler's parents had raised concerns about bruises, abrasions and a burn he had sustained but nothing was done about their complaints.
The court heard that child safety officers had concerns about the fact the 74-year-old woman was looking after a number of children at her age but there were no other carers available.
Michael Borusiewicz says he has spent the past three years fighting for the truth about what happened to his son.
"I'll never get Luke back but I want to know that I've done everything I possibly can while he was alive and after his death," he said.
He says there should be a royal commission into child safety services Australia-wide.
"Well they're not going to bring Luke back but I want to see a fairer system for parents that have never abused their children," he said.
The inquest is expected to run for three days.
Coronial Inquest for Luke Borusiewicz

_I made DoCS wait til I made this last film with Lukey, then they took him away._
Luke's Inquest was on 25-27 July 2012.
This photo was taken on my last visit with my Lukey Pookey, he died in my arms two weeks later. You can see the scratches on his face. I rang and rang trying to get him out of that house, away from that foster carer who had already been complained about over 20 times from abuse to other children. Pat Anderson, manager Cairns North DoCS wouldn't even return my calls, she knew all of this.
The next day at a visit with his mother she found severe scratches on his penis which had to be looked at by a doctor they were so bad.
Coronial Inquest for Luke Borusiewicz
The coroner is yet to hand down his findings on the death of my son, Luke Borusiewicz. On a personal note, I found the proceedings to be very disappointing and little short of a complete cover up. The coroner argued that it could not make a difference to Luke's chances of survival if he was left for one hour or six hours (he was left for six hours) with a fractured skull and bleeding on the brain. He did not agree with the saying used by doctors, "The First Golden Hour", a term used to highlight the importance of giving someone with severe head injuries medical attention within the first hour.
This being said, I rang up the foster home where Luke was incarcerated twice on that day. Firstly, only minutes after he had received his fatal injury, and the again six hours later to ensure that he had been checked on as I was distraught after the 74 year old foster carer had told me "He had banged his head and gone to bed!"
She had left him there all that time and only checked on him properly when I rang the second time.
When my legal team tried to bring up the fact that she was lieing during the inquest by stating that "She did not know he had hit his head". but could not recall when she had found out about it, but told the ambulance driver that Luke had hit his head, her lies were starting to be exposed, but the judge once again cut the questioning of my legal team short.
I know when I rang the first time she told me he had hit his head, why should she lie.... Her son is a lawyer, which made the whole court errupt in laughter when she came out with this fact. I was not laughing. Tell me he didn't go over what she should say? No doubt this was the cause for her to make a "second statement;"
I am not out for revenge, it just disgusts me that a witness at the inquest into my baby's death should sit there and lie, and her lies be covered up by the judge runing the kangaroo court.
Then I had to sit through a DoCS "Expert" on foster care. This woman did not do the inquest any favours. Initially I was under the impression that the inquest was to uncover the true cause of Lukey's death.
The doctor who did the autopsy concluded it must be what they said happened, he fell off the bed and hit his head. Other witnesses were shown a picture of the bed, but not this doctor. The bed was 30 cm off the ground. I ask you how a child can have a fatal injury from falling 30 cm. This line of questioning was once again prematurely shut down by the judge. Then there is the matter of Pat Anderson, the manager of the docs office in Cairns who was responsible for the abduction and death of my son. I was made to leave the court room while she gave her evidence as she would not face me.
Back to the fairies.... The DoCS witness on foster care. This woman proceeded to tell the inquest how perfect the foster care system is, and how outstanding every foster carer is. There are bad foster carers, only bad parents. Every single foster carer does it from the love in their hearts, not for money, not because they are child molesterors. How can they improve the system when the truth is not being told.
My personal opinion is that the inquest was nothing but a cover up, an my poor little Lukey's death has been swept under the carpet by these people, as much as possible anyway. Nobody does that to my boy! and I will continue to expose the corruption and evil that falsely portrays itself as child protection.

15 Questions With Luke's Dad About Luke's Army Child Protection Support Group
Archived Post 2012-11-22 · Lukes Dad
About Luke's Army
I am a father whose son was two years old when his head was smashed in and he was left to die in foster care. It took a week for Lukey to die, and he died in my arms when they unplugged the life support.
I promised Luke the last time I saw him as he lay in his coffin, I would do something about what they did to him, and I would fix the system. I started Luke's Army in his honor.
When you come into contact with these departments you soon realise you have nowhere to turn. Legal aid is more and more difficult to obtain, which necessitates the need for Luke's Army. The group is based on the principle that we are all equal, we are all there for advice and support which we receive from others in the group who have experienced the same ordeals, there is no room for being judgmental or arguementative.
The Luke's Army Group on facebook https://www.facebook.com/groups/LukesArmy evolves around this reasoning, with it's membership approaching 4000, while the website is a place for parents fighting an unfair and biased system to gain the media attention which is unavailable as a rule. The child protection departments hide behind a wall of strict media laws, and as with so much else in the child protection "industry", the laws that were made to protect children, are now twisted to suit the purposes of those running the show.
I am a child protection reform warrior, on the wrong team to be acknowledged, but a hero to the many victims of the system which has devastated the lives of so many in it's path, especially the children.
What I do, can never be recognised, never be measured in monetary or substance value. I have never charged money for helping people, I am paid in thanks and the experience I gain from each day, and the satisfaction I receive from giving people enduring the worst catastrophe of their lives the support they need, and helping to _bring them home._
Public perception is that any parent that deals with child protection is at fault, but this is not the case. There does not need to be any history of abuse or neglect, the department representative, quite often with no more than a fresh uni degree and no experience with children of their own, only need to state there is a "risk of harm" and this is enough for your children to be legally kidnapped.
At this point, the onus is on the department to validate the removal of the children by proving the parents are a failure as a parent, as a human being. There is no mercy, and should you react angrily or raise your voice as you watch these total strangers walk away with your children, you are only giving them more ammunition.
Part of my responsibility is to educate the public, to expose the real child protection, and this is done primarily on Lukey's website, http://lukesarmy.com which I have built from scratch.
We are all victims in Luke's Army, but some are lucky enough to have their children returned. Every person has their own tragic story about losing their children, and as bad as my own story is, it does not lessen the pain felt by others in the group pertaining to their own heartbreaking story.
In Australia we desecrated the lives of the Forgotten Australians, The Stolen Generation, The Migrant Children, The Forced Adoptions of Single Mothers, and now... The New Stolen Generation by DoCS.
The general public is ignorant to the child protection system, and this is what I aim for Lukey's Army to also do. Expose the disgusting truth about the child protection "industry." People should know never to trust them. They need to record everything, keep a diary.
Never ever ever ever go to them for help. I have met so many parents who have never abused their children. They became involved with DoCS when they went to DoCS fot help, and their kids were taken off them for doing what they thought was the right thing.
http://www.lukesarmy.com/content/epping-docs-stole-my-autistic-child-when-i-went-them-help
This is extremely common.
What are you currently working on in your organisation?
I am a support person for parents dealing with child protection, world wide, but especially in Australia. I have a constant stream of desperate parents contacting me for help. We are working towards increasing our numbers, to increase the support and knowledge available to those in need of support.
Many of us also believe that by publishing the endless stories of the system wrongfully removing, abusing and neglecting children that this problem cannot be ignored.
I also act as an activist to increase awareness of Luke's Army and what we are about, working to expose the truth about the system. Like all activists today, a large portion of my work is done on social media.
The website averages between five and six thousand unique visitors a month. On it I collect all the helpful links, information, groups and more, sorted into a help section for each country. There is also evidence of corruption and negligence sorted into countries.
This is where parents dealing with docs come for advice and support, from others who know what they are going through. Many of the parents who contact me are worst case scenarios, such as my own.
Currently, I have a question on the oursay.org website, where senior Australian politicians face questions from the public. People vote on the questions which are posted, and if your question has the most votes at the end, the politician it is directed at must publicly answer the question. On this occassion, you also are invited to sit with the minister and discuss your concerns.
My question is to Jenny Macklin, Minister for Families, Community Services and Indigenous Affairs and Minister for Disability Reform is currently first place. Here is the question I have asked, and the link to where you can give your support by using your seven votes to vote for my question to be put to the minister.......
“Everyone likes to jump on the "Stop Child Abuse" band wagon. With DoCS running it's own complaints line for their victims, you have the equivalent of a pedeophile priest answering complaints from choir boys who have been molested. When will this department be properly investigated and the corruption, negligence and cronyism exposed and removed. When will there be accountablilty for the blatant lack of professionalism in the department of community services across Queensland.”

http://oursay.org/all-about-families/everyone-likes-to-jump-on-the
What drew you to the not-for-profit sector?
I experienced the worst the system had to offer, and witnessed my son terrorised, kidnapped and killed. He was shifted to 12 different homes in 6 months until he was left to die aged two. I know what it is like to be in a DoCS office full of women who look at you with open hatred. I went into that office every single day after work, to show them I was clean (off drugs for six months), and working. It didn't matter how much we loved each other, or how hard I tried.
I don't like to talk about it. "I can talk about it to someone, or you can write it down on the site once, and tell thousands of people. I don't talk about what I do much to the people I am with, I don't need to push this movement down anyone's throat, enough people are finding out the truth.
So I thought instead of going over the same story again, I would post a blog here from Lukey's site.....
_Walk a mile in Luke's shoes._
Packing up to move on again, and I take these shoes with me everywhere I go, and a pair of his dirty socks wrapped in plastic to keep his smell in them.
One thing I am grateful for is that I never stopped telling Luke how much I loved him. I would say "I love you more than anything in the world, forever and ever Lukey", and he knew what I meant, because he loved me that much too. I must have said it to him twenty times a day.
Lukey didn't deserve to be dragged off screaming, then moved to twelve different foster homes in six months, until his head was finally smashed in and he was left to die at the age of two! And now I have to listen to them repeatedly, even at his inquest, telling me how well they looked after him, what a good job they did....
When I first walked into the hospital, the "reunification" bitch was there surrounded by police. It had happened the day before, Luke was left with a fractured skull and wasn't checked until I rang a second time six hours after his 74 year old foster carer told me "He's banged his head and gone to bed."
I begged her to check on him there and then. As soon as I got off the phone I rang docs Qld complaints who told me to ring the manager of Cairns North DoCS Pat Anderson, straight away. She wouldn't answer my calls.
I rang my visit supervisor, the commission for children, I tried and tried, until all I could do was sit in the corner and cry and cry and cry. I had a dream a couple of days before that Luke was in a little boat drifting out to sea, and I was standing on the shore watching him, there was nothing I could do. He was screaming to me, "Daddy! Daddy! Daddy!"
So the reunification bitch is surrounded by police and I said to her straight away, "I told you to get him out of that house."
All she could come back with was "You're raising your voice."
I said "Yeh, I get angry, I raise my voice. You get angry and you take people's kids off them."
The police looked away in agreement.
I had waited months for a meeting with that bitch, and had it 3 days before Luke's "Accident". I asked for longer unsupervised visits, and a few other things, but at the top of the list was "GET HIM OUT OF THAT HOUSE."
The day before at his visit he had huge scratches on his face. The next day at his mom's visit she found a scratch on his penis so bad it had to be seen to by a doctor. He was injured every time I saw him, severe burns and bruising. He was with a 74 year old foster carer who had four other children. I said to them at that meeting, "He is the size of a four year old but he is only a baby, the other kids are gonna bully him." The foster carer had been reported before for letting the kids bully the younger foster children, another thing I didn't know. She had many complaints lodged against her.
So I walked into intensive care and there was my little perfect angel, everything I lived for, in a coma. I said to him, "Lukey, Daddy's here."
Even though he was in a coma, tears started to roll down his cheeks. He knew I was there. I stayed by his side the whole six days he was there, singing to him, talking to him, so he knew his daddy was there and he was not alone. I did not want Lukey to die alone.
After three days, he was still relying on a machine to breathe for him, and they told me they were gonna turn off his life support. I walked in there and for the first time ever I yelled at my Lukey Pookey. I told him, "Breathe Lukey, Breathe. Breathe in...... Breathe out....' and I breathed in and out really loudly so that he could hear it.
Low and behold, my little champion started breathing for the first time since he was in the hospital. I was so happy, I knew he could hear me the whole time, but no one knew for sure because he was in a coma.
So there was hope, and they dismissed their plans to turn off Luke's life support. He breathed mostly on his own all that night until the next morning. But Lukey's brain was dying. He had been left for six hours with a fractured skull and bleeding on the brain which swelled and starved his brain of oxygen, the coroner would not acknowledge any of this. A blatant cover up of the negligence which caused the death of a baby, my baby.
So as Luke's brain died off in sections, he would lose control of each of his organs one by one. I asked if I could sleep with him and hold him through the night and they let me. When I woke up in the morning Luke had no reflexes at all left, it was like he had died in my arms during the night, only the machines were keeping him going.
I wouldn't get out of bed. It was 11 o'clock when the nurse came to get me. She told me the doctor wanted to see me. I told her I knew what it was about and I didn't want to go.
The doctor cried when he told us it was all over for Lukey. I begged them. I said I didn't care if he was a vegetable or in a coma, I would look after him and watch over him for the rest of my life. If they wanted to do experimental surgery, take my brain, anything, don't let my boy die.
They said they would leave him on life support until 10am the next morning. I asked if Luke's mother could sleep with him until midnight and I could lay with him until it was time to go, it was agreed.
Midnight came and the nurses came to get me. I told them to leave Luke with his mother, I just wanted him in my arms when they turned the machines off, it was like he had died in my arms the night before anyway. A sick child wants to be in his mothers arms, but I am sure a boy would die in his father's arms should he have a choice.
So Lukey's family all gathered round the next morning, they left it til 11Am so I could have more time with him, then they started to unplug everything. Lukey's heart kept going even after everything was unplugged, my little champion had a heart like a horse.
Then when I couldn't feel his little heart beating anymore, I took him into a room and laid him on the table, he was terrible to look at after having been such a beautiful child. Then all of a sudden I felt him come into my heart, and he was so happy, and he was saying to me, "I love you too Daddy, I love you too", over and over. I said I love you too Lukey Pookey so much, now you go with the angels now bubba, you go to God, he will look after you.
At Luke's funeral, I started off by playing Puff the Magic Dragon on the church piano as I sang it, it was our favourite song.
I thanked Lukey for giving me so many things, more than I had ever known in my life my Lukey gave me. Then when we all gathered around his coffin, I told everyone to lift him up on our shoulders and carry him out, because he is a champion and should be carried out like one.
Take a walk in Lukey's shoes, and then tell me your child protection system is working. You are desecrating families, children's lives, parents, making them give their whole life earnings, their children's inheritiance to solicitors, in your sick game where you get unlimited legal funding, fake psych reports, and you make any false allegations you choose without and proof needed, and then you hold no accountability when your have ruined these kids for life.
So Lukey never got a sorry, and after all the sorries, which are still dribbling out, I see no change, I see corruption openly flaunted by vindictive hateful managers of child protection and their minions, the reunification bitches and nasty caseworkers who gleefully take out personal vendettas on an decent parent who fights for what they love most in the world, their children.
And the politicians, the media, the DoCS workers who witness the corruption and say nothing. Just as guilty. You are all going straight to hell.
How long have you been working in the not-for-profit sector?
Luke died on the 18.1.06
What was your first job in the not-for-profit sector?
I built a website and started the group on facebook. I do it because it keeps Lukey a part of my life. I do it because I promised him I would. I do it because the biggest pleasure I have in my life now is the feeling I get from helping other people who are going through what I did.
That feeling of bewilderment, when people are so obviously permanently damaging your child while at the same time dismissing you as a parent. How can they know a child better than the parent in five minutes, a day, a week, a month... how can they possibly know more about what is better for the child than the parent who has been with the child their whole lives, and loves them.
What is the best thing about working in the not-for-profit sector?
Working with people who have no one to turn to, and being part of a massive support group, which instantly takes them in, listens to their story, shares their own experiences, gives advice, and we do it all together as a group.
I love being able to give these people a place to tell their stories on the internet, a site that is devoted to the topic of child protection injustices.
What do you like best about working in your current organisation?
I like the fact that Luke's life was not lost in vain. Luke has changed the world, and he will be remembered as the hero he is.
I like the fact that our group is coming together, growing numbers, and standing up to the system that has never been challenged on such a grand scale, or exposed.
We are not controlled by government laws and red tape, just a common tragedy, the forced removal of children.
I love the group because there is such a feeling of comradery between the members, and a feeling of impending change, where parents will get a fair go, where children will have a say in where they want to be, where foster carers will also be respected for their experience and their point of view, not bullied like even child protection staff are subjected to.
I love being able to say these things, to speak out against them, say the obvious, and promote the stories where the injustices are so blatantly present.
I consider my greatest achievement to be......
The exposure of corruption in the Atherton DoCS office resulting in the manager Vicki Reimannn being removed. Over 100 people from the local community and government departments wrote on the site exposing the blatantly corrupt manager.

Favourite saying ...
Life's misfortunes fall disproportionately upon the young.
I’m always being asked …
DoCS have my children, please help me, what can I do?
If you could have dinner with 2 people from history, who would they be?
Jesus and Lukey.
My greatest challenge is …
To be acknowledged by the people running the system as an acceptable advocate for child protection reform. Those who hate me, are the ones who would have things stay as they are, senior staff who have had it all their way for years, and the people they have trained to be like this. There are those who respect me for what I have done, and am doing, especially the many I have given a place of comfort to.
School taught me …
To type 75 words a minute. I knew there would be a lot of girls in the typing class so I did typing. :P
What does a typical day for you involve?
I try to post blogs on the site daily. I have more emails than I can keep up with. Facebook is a full time job, but I put it second to the site. There are also many people needing support.
What (or who) inspires you?
Obviously Luke, he was is and always will be my reason for living, but Jesus is my greatest hero. Modern day, Julian Assange has beat a path never before mached by government whistleblowers.
Best wishes for the Child Protection Reform Advocates in Canada From Lukey's Army

Christmas is the worst time of the year for most parents who are spending Christmas time without their children, and without a choice. It is agreed that we don't bring up Christmas time in the Luke's Army support group for parents on facebook at Christmas time.
For many, including myself, the group is a welcome distraction, and a family in it's own way, where support and friendship is assured. I remember last year I spent a couple of hours with my family and they questioned why I was looking so sad. I told them.... "Luke should be here with us, running around laughing and playing, happy, like I will always remember him." There are so many parents and children who are not looking forward to Christmas time.
So it is, that I send out my Christmas wishes, and messages, early this year. In my humble opinion, as an activist, I admire the friendly folk across the pond in Canada the most. They hold rallies and protests every week, there is never a sign of infighting or discontent, malice or jealousy, judment or belittling of their fellow protestors. They come up with merchandise, rock paintings, banners, shirts, put out magazines and books.... Not just for their own campaigners, but for all the groups, individuals, parents, angel children and children in care... Around the world. They are writing laws which are being approved by governments, but still there is such a long way to go.
I just wanted to thank you all from the bottom of my heart for including my Lukey Pookey in so many of the things that you do. I can't express how much I am greatful for the kindness, friendship and support that is always forthcoming, always beyond my expectations.
To give an example of the goodwill they exude in Canadian circles, I have copied a comment from one of those Canadian Child Protection Reform Warriors. Not made as an attempt to make a statement of any kind, simply a display of the warmth and compassion that never ceases to exude from these support people and groups in Canada....
Alfredine Linda Plourde A Message to All Foster Children
It hurts me up to know what you are all going through as foster children. I shed a tear when I think of all of you without parents, experiencing excruciating pain under the supervision of CCAS/CAS. I didn’t know so much pain existed in Canada, but I know now that the problems have been going on far too long. No one can promise you a life of joy, but I will do my best and my wish is that enough of us can come together to change things. What I can promise you is that I will not give up advocating on your behalf.
As a grandmother, I hope to do my very best to create a better system. It will not be easy, but it will be worth the effort. CCAS/CAS is only as powerful as the person at the top. He or she is simply a tool to guide the policies of the agency. I was raised in a foster home so I can relate to what it is like being a foster child. I was fortunate. A wonderful family opened its door and hearts to me. They didn’t do it for a pay cheque, there was none. They did it because they were good people, people who care.
In loving memory of my wonderful foster mom, the late Yvette Delisle, a native of St-Ambroise, Quebec, and to my foster dad Fernand Delisle, who lives in Seeley’s Bay, Ontario.
Dear Jesus,
I pray for those whose nightmares come in the day time and night time,
I pray for the one who have no one to love and spoiled them, who go to bed dirty, hungry and cry themselves to sleep, who live in constant fear, which live and move so often, and have
no sense of belonging.
I pray for children who want to be loved, and accepted, and for those who never give up hope, and for those who don’t have a chance, and for those that will grab the hand of anybody kind
enough to offer a gentle smile.
I pray for those that never seen a dentist, and for those who doesn’t know the meaning
of parental love.
I pray that you will take them under your wings.
In the name of Jesus
Amen

I drank hydrochloric acid (another suicide attempt by Lukey's Dad)

Luke is the best thing that ever happened too me.
He was taken from me again and again by child safety, with the only reason given was that I used drugs. I was six months drug free when they took him and had a reference from a senior sergeant of police and worked for a drug and alcohol counsellor of 25 years.
Reference from Police officer trying to help Luke's Dad get his son back.
I had him on antibiotics, they messed that up and his runny nose worsened into infected tonsils and ears.
He was put with his mother who had a 5 year history of abuse and neglect with her previous two children, and I have had no one ever report me to child safety.
I did everything I could to get my child back:-
-voluntary detox
-drug couselling
-voluntary urine tests
-anger management
-numerous references
-secured permanent safe place of residence(firstly with a mother and two children, then with a childcare worker)
After Luke died I drank Hydrochloric Acid. The people who saw me do it said I should have died. It wasn't a lot of Hydrochloric acid, but it put me in bed for a week and my friends were worried, they finally insisted I go to hospital.
They made me go through all of the symptoms, and the last thing I added to the list was that my big toe kept twitching.
I went through all the syptoms and the last one was my big toe continuously twiched since I drank the poison. Suddenly it dawned on me, I used to say to Lukey, "When I die Luke, I will be sitting on the end of your bed mate."
"Lukey" I said as I realised he had been pulling on my toe for the whole week.
"Don't give up daddy, keep goin" he said to me.
Immediately I was up out of bed and better again like nothing had happened.
Bereaved Parents Wish List

IN LOVING MEMORY OF My Lukey Pookey
I wish my child hadn't died. I wish I had him back. I wish you wouldn't be afraid to speak my child's name. My child lived and was very important to me. I need to hear that she was important to you also. If I cry and get emotional when you talk about my child, I wish you knew that it isn't because you have hurt me. My child's death is the cause of my tears. You have talked about my child and you have allowed me to share my grief. I thank you for both. Being a bereaved parent is not contagious, so I wish you wouldn't shy away from me. I need you now more than ever. I need diversions, so I do want to hear about you, but I also want you to hear about me. I might be sad and I might cry, but I wish you would let me talk about my child; my favorite topic of the day. I know that you think of and pray for me often. I also know that my child's death pains you too. I wish you would let me know these things through a phone call, a card or note, or a real big hug. I wish you wouldn't expect my grief to be over. These first years are traumatic for me, but I wish you could understand that my grief will never be over. I will suffer the death of my child until the day I die. I am working hard in my recovery, but I wish you could understand that I will never fully recover. I will always miss my child and I will always grieve that she is dead. I wish you wouldn't expect me "not to think about it" or "be happy". Neither will happen for a very long time, so don't frustrate yourself. I don't want to have a "Pity party", but I do wish you would let me grieve. I must hurt before I can heal. I wish you understood how my life has shattered. I know it is miserable for you to be around me when I'm feeling miserable. Please be as patient with me as I am with you. When I say, "I'm doing okay", I wish you could understand that I don't "feel" okay and that I struggle daily. I wish you knew that all of the grief reactions I'm having are very normal. Depression, anger, hopelessness and overwhelming sadness are all to be expected. So please excuse me when I'm quiet and withdrawn or irritable and cranky. Your advice to "take it one day at a time" is excellent advice. However, a day is too much and too fast for me right now. I wish you could understand that I'm doing good to handle an hour at a time. Please excuse me if I seem rude, certainly not my intent. Sometimes the world around me goes too fast and I need to get off. When I walk away, I wish you would let me find a quiet place to spend time alone. I wish you understood that grief changes people. When my child died, a big part of me died with her. I am not the same person I was before my child died and I will never be that person again. I wish very much that you could understand ~ understand my loss and my grief. But, I pray daily that you will never understand.

At least this baby got justice. I had to be told by the minister how well they looked after my baby, then sit through your bullshit inquest where you dismissed half the witnesses because you don't have time to give my son's death a proper investigation, he's only a baby.
Then I have to leave the court when the person in charge of the office that I tried again and again to contact gave evidence. Then I had to watch the foster care "expert" lie about how good the foster care system is.
Hurry up and come out with all of your lies about how my son's death could not have been avoided. Friggin evil lying bastards.

**_Note: I read a few lines of this fake inquest finding, and was disgusted at the blatant lies told about what DoCS did to my little Lukey Pookey, so I sent it onto a couple of people with experience in this type of thing, here are their replies..._**
From a mother who had her son muredered in foster care and then covered up...
I read it this morning mike haven't been n its f..king disgusting. They had a duty of care Mick, that duty they failed, not the old lady as such but Docs because she did not want the child under a certain age and was very specific, thats where there duty lies.
From a medical professional...
The beginning is just a cut and paste speal from DOCS mission statement about what they are about bullsh.t it is not a finding...the assessment reports about Luke are just opinion by those paid by DOCS etc...
The glaring obvious is that DOCS don't rate a mention til the final paragraph...they abdicate all responsibility to the NGO that engaged Joy...
1. An appeal will give you a voice because you are bringing the matter so get to submit your affidavit and evidence at the start and they are on then on the backfoot to try defend their actions.
2. Your solicitor should have let me pay for a second opinion on the forensics from the coroner, his report in non-medical terms is very vague and unconvincing...he is a w..ker...and a second opinion would easily have thrown great doubt on his report.
3. How have DOCS missed out on any mention???? 2 CSO's were at the house to pick up another child while Luke lay dying??? Joy told them she was sick and they did not inquire further about her capacity to care for 4 children at that time????
4. In an appeal you can present all the evidence on contact with Pat Anderson which is missing???
5. The "Fall" is all based on the verbal statements of 1 possible 2 children but no forensic evidence was found in Luke's room or the bed???? That does not make medical sense at all to me????
6. The report on Joy is a load of s..t...anyone can sit down and tell someone how great they are with children...that does not equate to real life caring.
7. Joy was 71 years old when she became a carer???? Age limits on carers should have definitely been considered...
8. Joy refused to accept Luke on 24 December the first time by her own admission that she could not care for Luke...why then does she accept care of him...
This inquest was not about a finding of negligence etc the terms were set to establish if anything could be done to prevent the same events occurring again to cause the death of a child....
I have far more questions then answers, the more I read the finding.... the more questions I have....
I don't see how the media can crucify you...there is NOTHING in that report that is in any way detrimental to you that I can see...It clearly states Luke was to be returned to your care....
TAKE CARE MY FRIEND...THIS IS NOT OVER ... BUT BY A LONG WAY....
From a foster carer in Cairns...
wtf mate
mutha farkes
Lies Mick they knew that old c..t was sick and didn't move any of the kids
I cant believe this is happening
all lies
lies
I know it is all lies too, I walked out of the inquest twice in disgust. I will not post the inquest here because I refuse to put up blatant lies about my dead son. Kevin Priestly you are one disgusting excuse for a judge, blatantly corrupt and covering up the death of a baby.
Father's call for change after harrowing inquest into death of two-year-old son
Melanie Petrinec | July 28th, 2012
Blonde-haired, blue-eyed Luke Borusiewicz, 2, died in January 2009 after hitting his head at a 74-year-old foster carer’s home while she was most likely passed out due to illness.
His father and mother Jackie Hurlstone sobbed yesterday as the final day of a coronial inquest heard he may have been unconscious for almost six hours before an ambulance was called.
Mr Borusiewicz was adamant when he spoke afterwards that "Lukey didn’t die for nothing", and he will now turn his attention to lobbying the State Government for more stringent foster carer criteria.
It emerged during the inquest that the elderly foster carer, who cannot be identified, had up to five children in her care and the toddler’s parents had complained repeatedly to Child Safety Services about the situation.
Yesterday, the manager of the department’s Far North Queensland operations admitted in court she did not return the phone calls of Mr Borusiewicz, who was a recovering drug addict at the time working to be reunited with his son.
His solicitor, Sandra Sinclaire of Bottoms English Lawyers, said Mr Borusiewicz was "rendered impotent by a system that didn’t want to hear his concerns".
"He intends to lobby the State Government about there being a maximum age for carers, a limit on the number of children placed in their care, parents being able to be considered as respite carers and mandatory response times to concerns raised by parents," she said.
The three-day inquest heard Luke was put in the woman’s care on Christmas Eve, 2008, despite her initial reluctance because she already had four foster children living with her.
She relented after a second phone call from agency Families Plus, which organised carers on behalf of Child Safety Services at the time.
On January 12, 2009, the carer was ill and coping with an upset Luke, who threw a tantrum because bad weather had stopped him visiting his father.
A nine-year-old child changed Luke’s nappy and fed him lunch as the woman succumbed to her illness, later estimating she passed out about three times.
While she slept, it is thought Luke fell from a bed and hit his head.
An ambulance was called when the woman could not wake him at 4.45pm.
Mr Borusiewicz’s barrister, Nerida Wilson, told the inquest during closing submissions yesterday that Luke could have hit his head as early as 11am.
He spent six days in a coma with a fractured skull before he died.
Ms Wilson said the carer told Families Plus she was ill on the morning of Luke’s death, but there was some confusion over whether she asked for help.
Mr Borusiewicz and Ms Hurlstone had complained that their son could not be supervised properly in a house of five children with an elderly carer.
"The parents’ concerns were never allayed, and when you look back there was justification for their concerns," Ms Wilson said.
Child Safety Services’ barrister, Karen Carmody, said changes had been made to the manual given to foster carers, urging them to contact the department if they needed temporary respite due to illness.
She said the elderly woman was a "magnificent carer" and the incident was a "tragic accident" that could have happened anywhere.
Coroner Kevin Priestly gave his condolences to Luke’s parents at the end of the inquest.
"I just can’t imagine what it would be like to actually have a child pass away; I think everyone here could not think of a greater loss," he said.
Mr Priestly is examining the circumstances surrounding Luke’s foster care placement, and will hand down his findings at a later date.
Child Safety took my boy away and they gave him back to me dead
Archived Post 2013-04-20 · Lukes Dad
LOOKING FOR ANSWERS: Michael Borusiewicz with his son Luke who died whilst in foster care.
SHE was tired, her medication sent her into a deep sleep and while she was unaware of what was happening, a little boy in her care died.
Note: This is the first of many blatant lies from coroner Kevin Priestly. It says in my police statement I rang the house five minutes after Luke received his fatal injury and the foster carer informed me that "He's banged his head and gone to bed." I asked her to check on him and he wasn't checked on til I rang back six hours later, and she finally checked on him. Phone records back this up. Kevin Priestly you might be a judge but you are a corrupt one... Michael Borusiewicz.
The tragic case of two-year-old Luke Borusiewicz has been flagged by a Queensland coroner as a reason to help the state's foster carers manage their fatigue.
Luke died in January 2009 while in the care of a 74-year-old woman who had three other foster children staying with her when she drifted into a deep sleep.
She has been cleared of any blame in his death but the case has highlighted the strains on the individuals who make the system work, and has left Luke's biological father angry.
Luke died after suffering a fractured skull in a fall from his bed while his carer was sleeping off fatigue caused by a change in her medication.
An inquest heard it was up to five-and-a-half hours before she discovered the little boy was unconscious and called an ambulance. The Cairns woman has been identified only as Joy.
Luke's father Michael Borusiewicz raised concerns at the inquest into his son's death over Joy's capability to care for so many youngsters. He also pointed to previous injuries sustained by the boy at the home as an indication of the woman's difficulty managing.
But Coroner Kevin Priestly yesterday found that Joy understood her limitations and acted within them.
"Finally, the number of children in Joy's care had no bearing on the circumstances of Luke's fall, the fact that Luke was not supervised when he fell, nor the delay in discovering he'd fallen and suffered a head injury," he said in a written finding.
The coroner also found no evidence that Child Safety failed in its responsibilities to care for and protect Luke or that the support provided to the carer by the Families Plus agency was inadequate.
But he said the circumstances surrounding Luke's death in January 2009 should be used as a case study in training foster carers and Child Safety officers in awareness of fatigue.
Luke's father dismissed the findings as "bullshit".
"Child Safety took my boy away and they gave him back to me dead," he said.
Mr Borusiewicz said he would put his energy into the Luke's Army group he formed for people battling child services. "I've lost my boy. When it happened to me, there was no one. I want to make sure other people have someone to go to," he said.
The inquest heard that Luke was removed from his parents Mr Borusiewicz and Jacqueline Hurlstone in July 2008 and placed in foster care. A change in the carer's personal circumstances meant Luke had to leave on Christmas Eve and, because Joy had provided respite care previously, she was asked to take him. Despite some reluctance, she agreed.
A girl, 9, and a boy, 3, were living with her in the three-bedroom house and on January 11 a girl, 12, arrived for a few days' emergency placement.
A regular contact visit between Luke and his dad the following day was cancelled due to flooding. Mr Borusiewicz rang the house just after 11am and Joy told him Luke had had a tantrum and gone to bed.
Mr Priestly found that Joy went to rest soon afterwards and slept until about 1.45pm when the 12-year-old girl was picked up.
"Joy laid down intending to rest and nap but fell into a deep sleep leaving the children unsupervised, an unintended consequence of her fatigue," he wrote.
The coroner found that soon after the carer fell asleep, Luke became upset and started jumping on his bed. The nine-year-old and, possibly the 12-year-old, saw him fall and hit his head on the metal bed frame and lino floor, causing a severe injury.
There was evidence that one of the girls put Luke back in his bed. Mr Priestly said he considered they did not understand the seriousness of his condition.
When she woke, Joy checked on Luke and thought he was asleep. It was not until between 4.30pm and 5pm, when she tried to wake the toddler, that she realised he was unconscious and called an ambulance. Luke had emergency surgery at Cairns Base Hospital for a fractured skull and swelling and bleeding to the brain but died six days later.
Forensic pathologist Dr Paul Botterill could not say whether the delay between the injury and treatment had any effect other than generally, the earlier the intervention, the better the chance of survival.
There was no evidence suggesting mistreatment.
Mr Borusiewicz had raised concerns about a burn and bruising when Luke was in respite care earlier with Joy. But the coroner accepted they were accidental injuries normal to a two-year-old.

My last visit with Luke before DoCS Cairns abused him to death
Archived Post 2013-10-26 · Lukes Dad
Luke was taken three times. The first time his mother told me she had given him amphetamines. It was not the first time she had abused him in this manner so I took the threat seriously and called an ambulance, and speudoepherdrine was found in his system. Nobody was interested in holding Luke's mum accountable, and I could do nothing but stay with the woman who was abusing my son, and try to protect him.
The second time they took him and found her her own unit, and came and took him away from his midday nap. I made them wait til I shot this last film of us playing piano and singing together.
I tried to tell them, but when I told the DoCS caseworker she had burnt him on the face with a cigarette and given him drugs, she laughed in my face, it was the second time they had laughed at me for reporting her, that hurt a lot.
Luke's mum had history with DoCS from her two older children, Lukey's two sisters. I had no history, yet I was never given a chance.
Luke's mom loved me and did not want to split up. I had secured full time work, and was almost off drugs, I just needed to get out of the town where my drug problems and temptations were, the last step in giving up, and it worked. I went to Townsville and was working for six months and Luke's mother brought Luke and met me there.
I went into the Townsville DoCS office every single day after work to show them I was working, I was off drugs, and to beg them for my little boy back, he was everything I lived for.
One day Lukey's mom was drunk and dragged him across the bitumen road out the front, he was screaming. It wasn't because he was naughty or anything, he was never naughty once in his whole life that I remember, she was just abusive towards him.
I heard the neighbours calling the police, so I called the police as I thought it was finally my chance to get rid of the person abusing my son, his mother. Not a hope. The police dragged Lukey away screaming, and all I could say was "That's my boy, that's my boy."
This is a memory I share with many people here. To witness the person you hold most sacred in your life being torn away from the person they love the most....
All about Luke.
So they shifted Lukey from foster home to foster home, he was only one year old then, and finally they shifted him back to Cairns and the Cairns North DoCS office of child abusers. When he was still in Townsville I went in for my daily visit to beg for Lukey back and walked in on a secret visit Townsville DoCS had organised for Luke and his mom, but they didn't organise one for me.
So they sent him back to Cairns, and I when they informed me at Townsville DoCS Luke was going back to Cairns, even though the judge in the Townsville court had ordered he was to stay in Cairns, I asked them if they were trying to get me back on drugs, forcing me to go back to Cairns. Once again they laughed in my face.
I went back to Cairns, and soon after moved to Cooktown, four hours away. When I told DoCS Cairns North that I was moving there and would travel to and from Cairns every week for the two hour visit, once again they laughed at me, and told me, "You won't do it."
The visits lasted three months until they abused my little baby to death. I never missed one visit, was never late, and I travelled eight hours every week so that I could stay off drugs for Lukey.
On that last visit day, when Luke suffered his fatal injury, my car wouldn't start. I think I caught a taxi to the bowling alley where our visit was, and was waiting there. There was a cyclone, and Cairns was flooding. Lukey made it fifty metres away, right in front of the bowling alley, but they couldn't reach me.
The visit supervisor rang me to ask if I wanted to meet Lukey in at the DoCS office, or reschedule the visit.
I alway worried too much when it came to Luke, and I did not want him travelling in the flood waters and cyclone winds. I told them to take him home and we could have the visit another day.
Anyone who has lost someone dear to them knows what it's like.
I should have told them to wait up the road, and walked through the flood to get to him. I should have told them to take him to DoCS.
I tried so hard to get him out of that foster home. When Luke arrived back at the foster home, he went upstairs and played with the other kids is the story. He fell off the bed and banged his head. I rang the foster home about ten minutes later worried that Luke might be upset. The foster mother answered and was really nasty.
"He's banged his head and gone to bed", she said.
I asked her to check on him, because his mum had banged his head before.
I told her he might be upset because he missed our visit, and she was really nasty once again when she said, "Yeh, he had to see someone."
I said to her, "You know how much he loves me", and she calmed down and agreed. Everyone could see quite easily how much me and Luke loved each other.
So that was it, they left him in bed, even though it was only ten o'clock and Luke had never been to bed before lunchtime during the day in his life, and they left him there with a fractured skull and bleeding on the brain, until I rang a third time around five o'clock.
The judge Kevin Priestley at Luke's inquest said it made no difference that he was left that long, bullshit.
So Luke stayed in hospital for a week, his organs dieing off one by one, until they put him in my arms and turned all the machines off.
One thing that I realised after Luke had died.... Those supervised visits at the playground.... At the end of every visit I would put Lukey in the back of the DoCS car and try to be as cheerful as possible and make out everything was normal, then as soon as he was out of sight I would drop to the ground and cry for ten minutes, then drive the four hours back to Cooktown. As look grew older he started to make movements for the exit gate of the playground, and motion for me to come with him, he wanted to leave with his daddy.
What I realise now is that as I would put Luke in the back seat each week and try to pretend that I wasn't upset so that Luke wouldn't get upset, Luke was doing the same thing for me. He knew how much it was hurting me to lose him.

Here is the story of the four children, one my own, and the three others belonging to other parents that I have met in the last year since my son died.
Like the others in our sad little group, I do not like to talk about what happened to my beautiful son, Luke Borusiewicz. I will say one thing, when I look at the photos of our last visit together, I can see the love for me in his eyes, on his poor little scratched face.
Two days later a scratch on his penis that needed him to be taken to the doctor it was so severe. They ignored pleas from myself and Lukes mother. These people answer to noone.
I have the parents of these deceased children's permission to discuss it though, and to cast it into the public light. None of us want our children to be forgotten, and we all want justice. I know it is inevitable that I will meet more parents whose children have died in foster care due to this departments blatant negligence. If you know of anyone, please send them to me, it is time that we all came together, and expose what has, is and will be happening.... michael@lukesarmy.com Here is my profile on facebook... http://www.facebook.com/group.php?gid=177005468124&v=photos&ref=ts#!/profile.php?id=100000922697911
This department believes that 100% of it's workers are right, 100% of the time. Nobody is perfect, we all know that. I tried and tried and tried to get my son back. Ask any one of the thousand who have been wronged by these child safety departments Australia wide, to these workers, many of the senior ones especially, this is some sick sort of game, where their prejudices and narrow mindedness is at the forefront, they are right no matter what, and if there is a personality clash, watch out, your child is going to pay for it.
My son was born on september 22 2006. He died on the 18th of January, 2009. He was two years and four months. It breaks my heart to talk about it, to think about it, I dream almost everyday about it, waking up crying, how I miss my son so much....After every visit I would watch them drive away with Luke and pretend all was as it should be, then drop to the ground and cry in front of the playground. Two hours a week for the last six months of his life was all I got to spend with the son I loved, adored, treasured, worshipped...and then he was sent back to foster care, a little baby being moved from strangers house to strangers house, not having a clue what was happening, terrifying to him, and to the father that loved him so much.
Because it pains me so to talk about it, I would ask that if you would like to know more about his story in particular, please visit the site I have built for him at http://lukesarmy.com
If you would like to show your support, there is little you can do apart from joining Luke's Army at that site, and also becoming a member of Luke's Army Group on Facebook.

The coroners report is going to take around three years I have been told. This should shed some more light onto what actually happened to Luke, how he was injured so severely, and why he had constant injuries, and why the department failed to act on this information, as well as the complaints from both Luke's Parents.
